Certificate of Occupancy / Change of Use Permit

Kalispell issues a Certificate of Occupancy (CO) to authorize occupancy of a building once the Building Department and every other applicable city department (Building/Fire, Parks, Zoning, Public Works, and Fire) has inspected and approved the completed work. A change of use or structural expansion in an existing commercial, industrial, or multi-family structure separately triggers Major Site Plan Review under Kalispell Municipal Code Section 27.20 before a building permit/CO can be finalized. Kalispell does not publish a standalone 'change of use permit' fee or application distinct from this Major Site Plan Review + standard commercial building permit + CO sign-off sequence — a genuine gap chased directly against the Building Fee Schedules page, the Planning Department Fee Schedule, and KMC 27.20 without finding a dedicated line item.

Requirements

  • A Certificate of Occupancy is required before a completed building may be occupied; it is issued only after the Building Department requests a final inspection and every applicable department — Building (building/plumbing/mechanical/electrical/accessibility/energy/life safety), Building/Fire (fire, sprinklers, fire alarms, alternate fire suppression, life safety), Parks (trees/landscaping/park land/bike paths, where applicable), Zoning (parking, architectural review, outdoor lighting, floodplain, signs, CUP, PUD), Public Works (streets/sidewalks/access/slopes/drainage/water & sewer/right-of-way), and Fire (fire lanes, access, hydrants) — has approved the project and notified the Building Department, per the City's Certificate of Occupancy Procedure
  • Other departments have five working days after the Building Department's final-inspection notification to inspect, approve or disapprove, and report back before the CO can issue
