Residential Building Permit (New Construction / Addition / Alteration / Repair)
VerifiedRequired for new single-family home construction, additions, alterations, and repairs within Libby city limits. Issued by the City of Libby under its DLI-certified local Building (B), RESIDENTIAL ONLY, program, using the City's own Libby Building Permit Application, reviewed by Building Inspector Walter Snyder against the 2021 IRC, 2021 IECC, and 2021 IEBC as referenced on the City's Building Inspector page.

Requirements
- Complete the Libby Building Permit Application: project location, owner/contractor/designer/electrician/plumber contact information, type of project (Residential, New/Addition/Alteration/Repair/Move/Demolition), description of the nature of the project, and estimated total cost (labor and materials)
- Submit one set of drawings/plans and specifications defining the scope, intent, and method of construction, typically including: (A) a site plan showing property lines, location of structures, existing/proposed utilities, parking areas, and adjacent streets/alleys; (B) floor plans showing use and relationship of spaces, sizes, doorways, windows, fixtures, stairways, and handicapped-accessible features if needed; (C) a section view through the building detailing size/type of materials and assembly method; (D) additional information may be required for commercial and multi-family structures or unusual/hazardous structures
- Since January 23, 2012, all new building permits must also be reviewed and signed off by the Lincoln County Floodplain Manager; if the property lies in a FEMA-regulated floodplain, a separate floodplain permit must be obtained from the County and a detailed floodplain map must accompany the application
- Construction may not begin until fees are paid and the permit is issued; separate electrical, plumbing, and mechanical permits issued by the State of Montana are required for all such work
- A Certificate of Occupancy must be issued before the building can be used

Commercial Building Permit (State-Issued)
VerifiedBecause Libby's DLI Building certification is scoped to RESIDENTIAL ONLY, any commercial building permit (new construction, addition, alteration, repair, change of occupancy) anywhere within Libby city limits is issued DIRECTLY by the Montana DLI Building Codes Bureau in Helena, not by the City of Libby, under the 2021 IBC as adopted statewide.

Swimming Pool Permit
VerifiedRequired for construction or installation of a swimming pool within Libby city limits. Libby is a Montana DLI-certified jurisdiction for Swimming Pool (SP) permitting, reviewed against the 2021 International Swimming Pool and Spa Code (ISPSC) as referenced on the City's Building Inspector page, using the same Libby Building Permit Application used for other building work.

- Submit a site plan showing pool location, setbacks, and barrier/fencing plan consistent with the 2021 ISPSC
- Reviewed and issued by the City of Libby Building Inspector under the City's DLI Swimming Pool (SP) certification — not routed to the state, unlike electrical/plumbing/mechanical work associated with the pool installation, which still requires separate state permits
- Since January 23, 2012, new building permits are also reviewed by the Lincoln County Floodplain Manager; a separate floodplain permit may be required if the property lies within a FEMA-regulated floodplain

Deck / Accessory Structure Permit
VerifiedRequired for decks, detached garages, and storage sheds 120 square feet or larger within Libby city limits, using the City's own Libby Building Permit Application under its residential Building (B) certification. Sheds/playhouses under 120 square feet are exempt.

Requirements
- Complete the Libby Building Permit Application with the appropriate Type of Project checkbox (Residential / Addition) and a description of the deck, garage, or accessory structure
- Submit a site plan showing the structure's location, dimensions, and setbacks from property lines, plus a section view/detail sufficient to show size and type of materials and assembly method
- Structures under 120 square feet in floor area (tool/storage sheds/playhouses) are exempt from a building permit; fences under 6 feet and retaining walls under 4 feet are also exempt

Demolition / Building Move Permit
VerifiedRequired for demolition or removal of any structure within Libby city limits, and for moving a structure, using the same Libby Building Permit Application with 'Demolition' or 'Move' checked under Type of Project. A DEQ-required asbestos inspection applies before demolition given Libby's documented asbestos/vermiculite legacy.
Verified 2026-07-03 · Source
Requirements
- Complete the Libby Building Permit Application with 'Demolition' or 'Move' checked under Type of Project, including a description of the nature of the project and estimated cost
- Per the Montana Asbestos Control Act (ARM 17.74.354) and a Montana DEQ memorandum distributed within the City's own Building Permit Requirements packet: an asbestos inspection by a DEQ-accredited (licensed) asbestos inspector is REQUIRED prior to building demolition, renovation, or remodeling activities, to determine whether asbestos-containing materials (ACM) are present
- Contact the Lincoln County Asbestos Resource Program (LCARP) hotline at (406) 291-5335, or submit a Property Evaluation Notification (PEN) form at lcarp.org/pen-form, for guidance and property status information specific to Libby's known asbestos/vermiculite contamination history
- Owner/applicant must confirm utility disconnection and site cleanup consistent with general City building-permit practice; a written verification from utility companies is good practice though not separately codified in the City's packet the way Billings documents it
- Violations of the Montana Asbestos Control Act carry penalties of $10,000 to $25,000 per day per the DEQ memorandum

Solar PV Permit (Alternative Energy)
VerifiedRequired for installation of rooftop or ground-mounted solar photovoltaic systems within Libby city limits. Because Libby holds no DLI Electrical certification, the electrical interconnection component is issued directly by the Montana DLI Building Codes Bureau in Helena as a Residential Electrical Permit with its 'Alternative Energy Source' add-on fee. A residential structural/racking Building Permit is separately issued by the City of Libby under its own residential Building (B) certification; a commercial installation's structural permit instead routes to the state, since Libby's Building certification does not extend to commercial work.
Verified 2026-07-20 · Source
Requirements
- Electrical interconnection requires a state-issued Residential (or Commercial) Electrical Permit from the Montana DLI Building Codes Bureau — Libby holds no electrical certification of its own
- The state Residential Electrical Permit application includes a distinct 'Alternative Energy Source' add-on fee (solar, wind, or hydro), charged in addition to the base electrical work fee selected on the same application
- For a RESIDENTIAL installation's structural/racking work, a City of Libby Building Permit (Libby Building Permit Application) is required, reviewed by Building Inspector Walter Snyder against the City's 2021 IRC/IECC/IEBC references, since Libby holds its own residential Building (B) certification
- For a COMMERCIAL installation's structural/racking work, the Building Permit is instead issued directly by the state DLI Building Codes Bureau, since Libby's Building certification is residential only
- Since January 23, 2012, any new City-issued building permit (i.e., the residential structural component) must also be reviewed and signed off by the Lincoln County Floodplain Manager
- Apply for the electrical component in accordance with Title 50, Chapter 60, Section 604, MCA and ARM 24.301.431

| City Building Permit Fee (residential structural/racking scope) — Total Valuation $1 to $500 | $24 | City of Libby Building Permit Requirements packet, Appendix L Permit Fees table — the same general valuation-based schedule used for other City-issued residential building permits; no separate solar-specific fee line is published. |
| Commercial structural/racking permit fee (state-issued) | Libby's Building certification is residential only; a commercial PV installation's structural building permit is issued by the Montana DLI Building Codes Bureau directly, and a jurisdiction-specific dollar figure was not re-extracted for this record. |
EV Charger / Electric Vehicle Charging Station Permit
VerifiedMontana has no dedicated EV-charger permit type or fee line, and Libby holds no DLI Electrical certification, so installing a Level 2 (240V) home EV charger or EVSE within Libby city limits requires a State of Montana Electrical Permit issued directly by the DLI Building Codes Bureau (Helena) -- not the City of Libby -- billed under the same general residential wiring/circuit line items used for any new dedicated circuit or service upgrade. A separate City of Libby Building Permit is only needed if the installation also involves new structural work (e.g., a new carport or accessory structure).
Verified 2026-07-20 · Source
Requirements
- Electrical work must be performed and the permit pulled by a Montana-licensed electrical contractor (LCO/UCO), per the Application for Residential Contractor Electrical Permit (Rev 6/24)
- If the EV charger is added as a new dedicated circuit to an existing panel with no service/panel change, this is billed under the form's 'Single Family Interior/Exterior Wire or Rewire' section, line H ('1 additional circuit or piece of equipment') or line G ('2-3 additional circuits or pieces of equipment') depending on scope
- If the installation requires a panel upgrade or new/upsized electrical service to support the charger's amperage draw, it is billed instead under the amperage-based 'Single Family Dwelling or Cabin' service tiers (A-D)
- The state application form has no Alternative-Energy-style checkbox or dedicated question set for EV chargers (unlike its Solar/Wind/Hydro section) -- EVSE is treated as ordinary residential branch-circuit wiring
- A City of Libby Building Permit is required in addition only if the EVSE is mounted on, or paired with, new structural construction (e.g., a new carport or accessory structure); not required for a simple wall/pedestal-mounted charger on an existing structure
Required documents
- RequiredApplication for Residential (or Commercial) Contractor Electrical PermitMontana Building Codes Bureau statewide form (Rev 6/24); mailed with payment to Building Codes Program, PO Box 200517, Helena, MT 59620-0517, or filed online via ebiz.mt.gov/bcb

|---|---|---|
| 1 additional circuit or piece of equipment (e.g., a single EV charger circuit added to an existing panel) | $45 | Montana Building Codes Bureau, Application for Residential Contractor Electrical Permit (Rev 6/24), line H -- no distinct 'EV charger'/'EVSE' line item exists on the state form; this is the general additional-circuit line an electrical contractor would use for a single new EV charger circuit, confirmed directly against the current fee schedule PDF |
| 2-3 additional circuits or pieces of equipment (e.g., EV charger plus other new circuits in the same job) | $70 | Application for Residential Contractor Electrical Permit (Rev 6/24), line G |
| Single Family Dwelling or Cabin -- up to 200-amp service (if the EV charger install requires a new/upgraded service) | $200 | Application for Residential Contractor Electrical Permit (Rev 6/24), line A -- applies if a panel/service upgrade is needed to support charger load rather than a simple additional circuit |
| Residential Change of Service -- exterior meter base & interior/exterior main disconnect only | $45 | Application for Residential Contractor Electrical Permit (Rev 6/24), line I |
| Request Inspection, per hour | $60 (plus $30 per additional 30 minutes or fraction thereof, plus travel time) | Application for Residential Contractor Electrical Permit (Rev 6/24) |
Sign Permit
VerifiedLibby does not have a standalone city sign-permit application or fee. The City's zoning ordinance (Title 17) contains a 'Signs' section in several district chapters, but the two zoning districts that actually cover Libby's commercial corridors -- Downtown Business District (17.24.140) and Highway Commercial District (17.25.100) -- each publish their 'Signs' section as 'Reserved,' with no adopted standards, application, or fee, per the current Jan 8, 2026 Municode version fetched directly. The Residential Business District (17.20.030), a residential-to-commercial transition district, does have adopted sign size/type limits, but no associated permit or fee process is described there either. A sign requiring structural engineering review on a COMMERCIAL building is instead permitted the same way as any other commercial building work in Libby: directly through the Montana DLI Building Codes Bureau, since Libby's own DLI Building certification is residential-only. A sign's electrical/illumination component always requires a separate State Electrical Permit, since Libby holds no DLI Electrical certification.
Verified 2026-07-22 · Source
Requirements
- In the Residential Business District (Libby Municipal Code 17.20.030): signs must not materially alter the appearance of the lot/dwelling; no electronic signs; illuminated signs must be downward-directional; real-estate/lease signs limited to 8 sq ft total; signs bearing an occupant's name/occupation limited to 6 sq ft per family housed; institutional (e.g., church) signs limited to 12 sq ft; non-illuminated political/campaign signs are allowed but must be removed within 3 days after the election
- Downtown Business District (17.24.140) and Highway Commercial District (17.25.100) -- Libby's two zoning districts covering its actual commercial corridors -- each list a 'Signs' section that is currently published as 'Reserved,' meaning no adopted district-specific sign standard, application, or fee currently exists in the ordinance text for these commercial districts
- A sign requiring structural anchoring or engineering review on a commercial building must be reviewed under the same 2021 IBC-based Commercial Building Permit issued directly by the Montana DLI Building Codes Bureau, since Libby's own DLI certification does not extend to commercial structures
- An illuminated or electrically connected sign, residential or commercial, requires a separate state Electrical Permit from the DLI Building Codes Bureau, since Libby holds no DLI Electrical certification
- No Montana sign-contractor-specific license was found; general contractor and/or electrical-contractor licensing requirements apply based on the trade performed
Required documents
- OptionalLibby Building Permit Application (if structural sign work is attached to a residential-certified-scope structure)Same combined City of Libby application form used for other building work, describing the sign's structural scope
- OptionalApplication for Commercial Building Permit (state, if the sign is attached to or requires structural review as part of a commercial building)Montana DLI Building Codes Bureau statewide form, since Libby's own Building certification does not cover commercial structures
- OptionalApplication for Residential or Commercial Electrical Permit (state, if the sign is illuminated or electrically connected)Montana DLI Building Codes Bureau statewide electrical form, since Libby holds no DLI Electrical certification
Fee schedule
| Fee type | Amount | Notes |
|---|---|---|
| City sign-specific permit fee | No standalone city sign-permit fee line exists; Libby's own zoning ordinance sign sections for its two commercial districts (Downtown Business 17.24.140, Highway Commercial 17.25.100) are both published as 'Reserved' with no adopted fee schedule, confirmed directly against the Jan 8, 2026 Municode version. A structural component would instead be billed under whichever general building-permit fee track applies (City Appendix L for a residential-certified project, or the state's commercial fee schedule); an electrical component would be billed under the state Electrical Permit fee schedule already documented elsewhere in this file. Left null rather than invented. |
Fire Sprinkler / Fire Alarm System Permit
VerifiedMontana has no jurisdiction-level fire-code certification distinct from Building certification, and Libby carries no fire ('F') designation on the DLI's own Certified Local Government Program roster -- Libby holds only Building (B), RESIDENTIAL ONLY, plus Swimming Pool (SP). A fire sprinkler or fire alarm system tied to a COMMERCIAL building in Libby is therefore reviewed as part of the same state-issued Commercial Building Permit (Montana DLI Building Codes Bureau, Helena) that already governs all other commercial construction in Libby, under 2021 IBC Chapter 9 (Fire Protection Systems) and referenced NFPA standards, since Libby's own DLI Building certification does not extend to commercial structures. A fire sprinkler system tied to a qualifying RESIDENTIAL project instead falls under the City's own residential Building Permit. Separately, any business installing, servicing, or maintaining fire alarm or fire sprinkler/suppression systems anywhere in Montana, including Libby, must hold a Montana Fire Protection License issued by the DLI's Board-administered Fire Protection License Program, and the Montana State Fire Marshal (Dept. of Justice, under MCA Title 50, Chapter 3) retains separate statewide inspection authority over public, business, and industrial buildings including their fire protection systems.
Verified 2026-07-22 · Source
Requirements
- Fire sprinkler/alarm systems installed as part of new commercial construction or a commercial remodel in Libby are reviewed by the Montana DLI Building Codes Bureau as part of the Commercial Building Permit application, since Libby's own DLI certification is residential-only
- Fire sprinkler/alarm systems installed as part of a residential project within Libby's own DLI-certified scope are reviewed by the City of Libby Building Inspector as part of the standard Libby Building Permit Application
- The business performing installation, service, or maintenance of the fire alarm or fire sprinkler/suppression system must hold a current Montana Fire Protection License (Business Entity endorsement), and the individual technician must hold the corresponding Individual Endorsement, issued by the DLI Board-administered Fire Protection License Program
- The Montana State Fire Marshal (Department of Justice) has statewide statutory authority under MCA Title 50, Chapter 3 to inspect public, business, and industrial buildings, including their installed fire protection systems, for code conformance
- No separate City of Libby fire-department plan-review or permit fee for sprinkler/alarm systems was found; the Libby Volunteer Fire Department's own public-facing page (Fire Chief Steve Lauer) lists no permitting, plan-review, or fire-code-enforcement function distinct from the state-level review already described
Required documents
- RequiredApplication for Commercial Building Permit (state) or Libby Building Permit Application (city, residential-certified scope)Same underlying application already used for the commercial or residential building project the fire protection system is installed as part of; no separate freestanding fire-sprinkler/alarm application form was found published by either the City or the state DLI Building Codes Bureau
- RequiredMontana Fire Protection License (Business Entity + Individual Endorsement)Proof that the installing/servicing contractor holds a current license from the DLI Board-administered Fire Protection License Program, required statewide for anyone selling, installing, or servicing fire alarm or fire sprinkler/suppression systems
Fee schedule
| Fee type | Amount | Notes |
|---|---|---|
| Fire-sprinkler/alarm-specific permit or plan-review fee | No dedicated fire-sprinkler/alarm fee line is published by either the City of Libby or the Montana DLI Building Codes Bureau; the DLI's own Building Permits page lists Boiler, Building, Electrical, Elevator, Factory-Built Building, Mechanical, and Plumbing as its only distinct permit types, with no Fire Sprinkler or Fire Alarm permit type listed. A fire protection system installed as part of a commercial project is priced within the same valuation-based Commercial Building Permit fee already documented for Libby (see commercial-building-permit-state in this file), not as a separate line item. Left null rather than invented. |
Change of Use / Certificate of Occupancy
VerifiedLibby does not have a separate standalone 'change of use' permit product or application. The City's own Building Permit Requirements packet states plainly that 'a permit IS required any time the use of a building is to be changed,' processed through the identical Libby Building Permit Application used for construction, addition, alteration, repair, move, and demolition projects -- there is no distinct Change-of-Use checkbox on the form's Type of Project list. A Certificate of Occupancy (CO) must be issued before a building can be used, per item 6 of the same application. Because Libby's own DLI Building certification is residential-only, a change of use affecting a COMMERCIAL building is instead processed directly through the Montana DLI Building Codes Bureau's Commercial Building Permit, reviewed against 2021 IBC/IEBC change-of-occupancy provisions -- the same routing already documented for all other commercial building work in Libby.
Verified 2026-07-22 · Source
Requirements
- Complete the same Libby Building Permit Application used for other work, describing the nature of the use change; no distinct Change-of-Use checkbox exists among the form's Type of Project options (Commercial/Residential/New/Addition/Alteration/Repair/Move/Demolition), so applicants typically select the closest applicable category (e.g., Alteration) and describe the use change in the project narrative
- For a RESIDENTIAL-certified-scope change of use, the City of Libby Building Inspector reviews the application against the 2021 International Existing Building Code (IEBC), which the City's own Building Inspector page lists among its referenced codes
- For a COMMERCIAL building's change of use, the application routes directly to the Montana DLI Building Codes Bureau (not the City), consistent with Libby's residential-only Building certification, and is reviewed under the 2021 IBC/IEBC
- A Certificate of Occupancy must be issued before the building can be used under its new use/occupancy classification, per item 6 of the City's own Building Permit Application form
- Since January 23, 2012, any new City-issued building permit -- including one triggered by a change of use -- must also be reviewed and signed off by the Lincoln County Floodplain Manager
Required documents
- RequiredLibby Building Permit Application (or state Application for Commercial Building Permit, if the affected building is commercial)Same combined form used for other City building work, or the state's commercial building permit application if the change of use affects a commercial structure, describing the existing and proposed use
Fee schedule
| Fee type | Amount | Notes |
|---|---|---|
| Change-of-use-specific fee | No separate change-of-use or certificate-of-occupancy fee line is published by the City of Libby distinct from its general valuation-based Appendix L building permit fee table; a change of use is billed as an ordinary building permit application under that same schedule (see residential-building-permit and commercial-building-permit-state in this file for the applicable fee tables). Left null rather than invented. |
