Change of Use / Change of Occupancy Permit
Fernley does not have a standalone 'change of use' application. A change of use or occupancy classification for an existing commercial building or tenant space is filed on the same Building Permit Application-Commercial used for new construction, remodels, and tenant improvements, by checking 'Change Of Use' as the project type and stating the Previous Occupancy and Proposed Occupancy classifications. It is reviewed against the City's adopted 2024 International Existing Building Code (IEBC) — whose Chapter 10 governs Change of Occupancy — alongside the standard IBC occupancy/construction-type requirements.

Requirements
- Building Permit Application-Commercial (REV 05/2023 or later) used for a change of use, with the 'Change Of Use' box checked among the project-type options (alongside New Construction, Site Improvements, Remodel/Addition, Demolition, HVAC-Rooftop, New Tenant)
- Application requires stating the Building Code Year and Edition, Previous Occupancy, and Proposed Occupancy classification, plus Occupancy Classification and Use, Type of Construction, and square footage for each use/occupancy on the project
- Governed by the City's adopted 2024 International Existing Building Code (IEBC), Fernley Municipal Code Sec. 8.02.01, which contains the Change of Occupancy provisions (IEBC Chapter 10) applicable when a building's occupancy classification changes
- Commercial Plan Submittal Checklist requirements apply if the change of use is accompanied by any construction, alteration, electrical, plumbing, or mechanical work (e.g., a detailed code analysis, floor plan showing occupancy loads/egress, and a Fire Authorization Form)
- Existing/Proposed Fire Sprinkler System and Existing/Proposed Fire Alarm System fields on the Commercial application must be answered; adding or altering fire protection systems as part of the occupancy change requires a separate permit from the North Lyon County Fire Protection District (see the fire-sprinkler-alarm-permit entry)
- A change in occupancy, operation, tenancy, contractor of record, or ownership under an existing permit requires that a new permit be issued — an existing permit is not transferable to a new use

Commercial Building Permit (New Construction / Additions / Tenant Improvements)
VerifiedRequired for commercial, industrial, and multi-family building work in Fernley: new construction, site improvements, remodels/additions, rooftop HVAC replacement, change of use, and tenant improvements ('New Tenant'). One combined permit covering structural, electrical, plumbing, and mechanical scopes, filed on the Building Permit Application-Commercial (REV 05/2023) with the signed Commercial Plan Submittal Checklist, and reviewed against the City's adopted codes (2024 IBC/IMC/IFC/IFGC/IECC/IEBC, 2024 UPC/UMC, 2023 NEC, plus 2024 NNICC amendments — mandatory for all new submittals since January 1, 2026). Fernley publishes NO separate tenant-improvement permit: a TI is the same commercial building permit with the 'New Tenant' project-type box checked, billed on the same valuation-based fee schedule (the only TI-specific published fee line is a $300 Engineering Tenant Improvement Plan Review in Resolution 20-009, Exhibit B).

Requirements
- Only a properly licensed State of Nevada General Contractor or Nevada Registered Design Professional may apply for a commercial construction permit under Nevada law (NRS 624); owners, tenants, or employees of commercial buildings may NOT apply for permits nor perform construction on the building unless properly licensed, or the work is exempt under NRS 624.031 and IBC 105.2
- Any project involving more than 3 trades (e.g., structural, plumbing, electrical) must have a General Contractor in charge; a GC may not self-perform plumbing, electrical, refrigeration, HVAC, or fire protection without the specific NRS 624 license — properly licensed subcontractors are required for those trades
- Building Permit Application-Commercial (REV 05/2023) completed with: project type (New Construction / Site Improvements / Remodel-Addition / Demolition / HVAC-Rooftop / Change Of Use / New Tenant), trades in scope (structural/electrical/plumbing/mechanical), APN and address, tenant/business information and hours of operation, property owner, GC's Nevada Contractor's License and City business license, building code year and edition, previous and proposed occupancy, area of work and total building square footage, IBC construction type and occupancy classification per area, and project valuation (cost of construction labor and materials, with cost of site improvements stated separately)
- Additional Contractor Information page (REV 08/2024) listing architect, engineer, and electrical/mechanical/plumbing/stucco subcontractors with state license and City business license numbers
- Two (2) site plans, two (2) complete building sets, and a flash drive with PDF files; plans to scale in blue or black ink on clear unlined paper, minimum sheet size 18 x 24 inches; plans prepared and stamped/signed by a Nevada Licensed Design Professional or Nevada State Contractor
- Title sheet with code analysis, IBC occupancy type(s) and construction type, square footage of each occupancy group, plumbing fixture schedule, sheet index, vicinity map, APN, and preparer information
- Site plan showing all existing/proposed structures and ground-mounted equipment, utilities (with plan-and-profile sheets for water and wastewater), backflow devices, sewer laterals, domestic water meters and a separate irrigation meter, utility abandonments, easements, setbacks, ADA accessibility (parking, routes of travel, signage, ramps, detectable warnings, slopes), temporary and permanent erosion control, stand-alone retaining walls, and impervious-surface coverage percentage

- Energy conservation compliance per the adopted IECC: a passing DOE COMcheck report signed by the design professional
- Structural package: fully dimensioned foundation plan, floor and roof framing plans, structural details/notes, two (2) digitally stamped/signed sets of structural engineering calculations, two (2) wet-stamped truss calculation sets with an Engineer of Record letter of compliance, and two (2) stamped geotechnical report sets where required
