Artesia building permits

Requirements

• Building permit required before any regulated building or structure is erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted, or demolished, per the City's 'Residential Building Permit Guide' (citing NMRBC R106.1)
• Limited exemptions exist (e.g., detached accessory structures 120 sq ft or less used as tool/storage sheds still require a plan-review permit; retaining walls 4 ft or less; decks 200 sq ft or less that are not more than 30 inches above grade and not attached at a required egress door) -- per NMRBC R105.2 as cited in the City's own guide; even exempted work still requires separate electrical/plumbing/mechanical permits where applicable
• Complete a Building Permit Application (universal City form covering Building/Electrical/Plumbing/Mechanical/Gas/Fence/Sign/Lane-Alley Closure/Other) identifying owner, contractor (with NM State license number and classification) or a notarized Homeowner's Responsibilities checklist, responsible design professional, project description, valuation, and total square footage
• Submit two (2) complete sets of building plans plus two (2) plot plans (residential); the City's plan-submission instructions state plans should be scaled to 1/4in = 1ft-0in on paper no smaller than 11in x 17in, while a separate residential plan-requirements handout states a 1/8in minimum scale -- both documents are current on the City's site and are not fully reconciled with each other, so confirm the required scale with Planning & Zoning before submitting
• A signed copy of the contract between the project owner and the contractor must be submitted with the application; project valuation for fee purposes is based on Municipal Code Title 8 Chapter 1
• Zoning approval from the City of Artesia or Eddy County may be required and must be obtained before submitting the building permit application, depending on the project's location
• A separate septic-tank permit from the local New Mexico Environment Department office is required if an individual liquid-waste system is being modified or installed (not part of the City's own building permit)
• Professional (architect/structural engineer) seals are required for certain construction types per NMAC 14.5.2.10(B) as cited in the City's guide (e.g., steel-stud/structural-steel construction, all pre-fabricated/pre-manufactured/component structures, wood foundations, retaining walls over 3 ft, second-story additions, and alternative materials/methods), but are not required for ordinary 1-2 story single-family/duplex construction absent such conditions

• Same universal Building Permit Application used for new construction, with 'Alteration/Repair' or 'Addition' checked under Building Type
• For alterations/repairs without structural changes, two sets of lists outlining the work to be performed and materials to be used are accepted in lieu of full construction drawings, per the City's Residential Building Permit Guide
• For additions, the floor plan must show the addition and all existing adjoining rooms/doors/windows, with distances from property lines and existing structures, and must not block an existing sleeping room's required egress
• For window replacements, a complete list of windows is required, showing size, sill height, location, and energy rating (heat gain and U-factor), and whether tempered/emergency-egress-rated; replaced windows must meet current emergency egress, safety, and energy requirements
• For kitchen/bathroom remodels, existing and proposed floor plans (2 sets) are required; range-hood replacements must vent to the exterior or use a listed ductless hood
• If the work will disturb materials suspected to contain asbestos, contact the Planning & Zoning office before commencing alterations, repairs, or demolition

• Complete a Building Permit Application, submitted with three (3) copies of complete building plans and three (3) plot plans
• Contractor must possess a current and valid GB98 contractor license issued by the New Mexico Construction Industries Division and must sign the permit application
• Zoning approval from the City of Artesia or Eddy County may be required prior to submitting the building permit application
• Plans scaled to 1/4in = 1ft, submitted in three sets; submission of an additional single-file digital copy is recommended by the City to expedite review
• Cover sheet must annotate applicable codes and design criteria: building construction type (IBC Chapter 6), occupancy group/mixed occupancies (IBC Chapter 3), occupant load (IBC Chapter 10, Table 1004.1.1), allowable area calculations, exiting requirements, plumbing fixture requirements (IBC Chapter 29), applicable fire sprinklers, height/number of stories, and land use zone
• Structural calculations covering the entire structural system (wind, roof, floor, and snow loads) must be provided

Requirements

• Complete a Manufactured Home Placement Permit application and provide a complete site plan
• Address flood-zone requirements if applicable; if the site is in flood zone AO-1' or AO-2', a separate Flood Plain Use permit must also be completed
• Obtain zoning approval for the location and type of manufactured unit, and confirm the structure meets requirements for the applicable structure type (commercial or residential)
• After City zoning/site approval, obtain the underlying Manufactured Unit Installation permit from the New Mexico Manufactured Housing Division (MHD)
• Provide a copy of the State MHD installation permit to the City of Artesia Planning Department; only then will the City issue the Manufactured Home Placement Permit
• Obtain separate Plumbing and Electrical permits from the City as needed (e.g., electrical/gas meter clearances, sewer tap, gas/water/sewer yard lines)
• City inspection approvals for electrical, plumbing, and setbacks are required after the unit is on site and before the MHD inspector's final approval
• Certificate of Occupancy is issued by the State of New Mexico, not the City, upon completion of MHD's requirements and final approval

• Demolition permit required per the City's 'Do I Need A Permit?' chart, which lists both Building and Fire review as required for demolition (no 1-2-family-home exemption is listed for demolition, unlike most other categories on that chart)
• A separate fire-code construction permit is required under Sec. 105.7.20 of the City's locally amended 2015 International Fire Code: 'A permit is required for the demolition of any structure, including but not limited to, buildings, fire department access roads, bridges, or towers'
• Two site plans identifying the structure(s) to be demolished are accepted in lieu of full construction drawings, per the City's Residential Building Permit Guide
• If asbestos-containing materials are suspected, contact the Planning & Zoning office before commencing demolition
