Codes adopted

THE CITY CITES ITS OWN CODE FOR THE PERMIT MACHINERY rather than publishing an edition list on these pages: CMC 18.04.015 for work exempt from a permit, CMC 18.04.020 for the routing of plans to city divisions, and CMC 18.04.035 for the one-year life of a plan check.THE STATE CODES ARE NAMED THROUGH THE EXEMPTION FORMS: the city publishes form B-38 for "Work Exempt from Residential Permit" based on the California Residential Code, and form B-39 based on the California Building Code.CALGREEN IS NAMED WITH A SUBSTANTIVE REQUIREMENT: "Under the California Green Building Standards Code (CALGreen), at least 65% of non-hazardous construction debris must be recycled or salvaged for reuse."EXEMPT WORK STILL HAS TO COMPLY: "Work exempt from a permit must still comply with applicable Building Codes, State of California Codes, City Codes, and all other applicable ordinances."THE ADOPTING CHAPTER'S EDITION LIST WAS NOT READ FOR THIS RECORD, so no Carlsbad ordinance number, code edition or local effective date is asserted.Health & Safety Code 18938(b) provides that building standards in the California Building Standards Code "shall apply to all occupancies throughout the state and shall become effective 180 days after publication."

Building Permit

Carlsbad runs three application routes - online, by email and in person - and the choice is close to irreversible: once a submittal is determined hard copy it stays hard copy for the life of the permit. Construction waste reporting runs through a third-party platform that gates both the permit and the final inspection.

Requirements

  • TWO APPLICATION FORMS SPLIT BY OCCUPANCY: "Residential projects require a residential B-1 application form along with other supporting forms/documents. All non-residential/commercial projects require a commercial B-2 application form".
  • THE HARD-COPY DECISION IS EFFECTIVELY PERMANENT: "When minor permits are unavailable online, hard copy submittals are required. Once an application is determined hard copy, it will remain that way the life of the permit."
  • NO WALK-INS FOR A NEW SUBMITTAL: "Walk ins are not allowed for new/initial submittals. Appointments are required." And "Incomplete submittals are not accepted" - stated twice on the page.
  • REVIEW DOES NOT START UNTIL THE MONEY DOES: "For those that require plan check, reviews will not begin until fees are paid." On the in-person route the fees are due at the appointment itself: "Bring a form of payment and be ready to pay initial plan check fees."
  • THE PORTAL ACCOUNT IS NOT INSTANT: "You can expect an email confirmation within one to two business days confirming your online portal access." The city phrases it elsewhere as the city reviewing the request "and respond in a day or so."
  • PLAN CHECK HAS A ONE-YEAR LIFE: "The plan check process extends for one year from the date of submittal. All reviews not completed within one year will expire. In order to renew an application after expiration a new set of plans must be submitted with payment for the subsequent plan review. (CMC 18.04.035)"
  • A CONSTRUCTION WASTE MANAGEMENT PLAN COMES BEFORE THE PERMIT: "Applicants for qualifying projects must submit a Construction Waste Management Plan through Green Halo before a permit is issued."

The city publishes free pre-approved ADU plans "intended to encourage the development of accessory dwelling units by saving homeowners three to six months of planning and design time and the approximately $8,000-$16,000 in private architectural design fees associated with preparing ADU building plans." That is the city's own estimate of an avoided PRIVATE cost, not a city fee.
