Accessory Dwelling Unit (ADU) Permit

Verified

Required for construction of an accessory dwelling unit (ADU, also called guest house/casita) on a residential property in the City of North Las Vegas. Local dimensional standards are codified in NLV Municipal Code Title 17 (Zoning), §17.20.030.F.2 — Accessory Dwelling Units (Supp. 144). In the single-family residential districts (O-L, R-E, R-EL, R-1) an ADU requires a special use permit and is limited to lots ≥6,000 sq ft; the ADU must be 200–800 sq ft and may not exceed 50% of the principal dwelling's gross floor area (whichever is less). NLV (population 60,000+) is also subject to NRS 278.257 (eff. July 1, 2026), which mandates NLV authorize ADUs on single-family residential lots and prohibits any local ordinance from barring the owner from renting the ADU as long-term housing (transient/short-term lodging may still be prohibited); local conditions more restrictive than that statute are superseded as of July 1, 2026. Governed by the 2024 IRC with Southern Nevada amendments.

Verified 2026-07-17 · Source

Requirements

  • In O-L, R-E, R-EL, and R-1 districts an ADU is allowed only by special use review and only on a lot of at least 6,000 sq ft whose principal use is a single-family dwelling (NLVMC §17.20.030.F.2.c)
  • ADU gross floor area: minimum 200 sq ft; maximum is the lesser of 50% of the principal dwelling's gross floor area or 800 sq ft; a tiny house may not exceed 400 sq ft (NLVMC §17.20.030.F.2.c.iv)
  • ADU must contain its own kitchen and restroom facilities (NLVMC §17.20.030.F.2.c.ii)
  • No more than one ADU per lot, and no ADU may be located within 300 ft of another ADU in these districts (NLVMC §17.20.030.F.2.c.v–vi)
  • At least one off-street parking space in addition to that required for the principal use, and no more than two off-street spaces for the ADU (NLVMC §17.20.030.F.2.c.vii)
  • Mobile homes, recreational vehicles, and travel trailers may not be used as ADUs; the ADU may not be sold apart from the principal dwelling; home occupations are prohibited in an ADU (NLVMC §17.20.030.F.2.c.iii, x, xi)
  • A 'Guest House/Casita' is separately permitted (P) by right in the R-E, R-EL, R-1, and R-CL districts per Table 17.20-3; ADUs (with full kitchen) are 'S' (special use) in those single-family districts and 'P' in PUD/PID, MUD, and PCD districts
  • NRS 278.257 (eff. July 1, 2026) prohibits: prohibiting separate kitchen facilities, requiring >1 extra parking space (where existing + street parking is adequate), requiring street improvements except for construction-disturbance repair or public health/safety, setbacks more restrictive than the primary residence, or barring the ADU from long-term rental housing — these supersede any more-restrictive Title 17 condition as of that date (NRS 278.257(2), confirmed via direct statute text 2026-07-17). NOTE: the statute contains no owner-occupancy provision, and NLV's own Title 17 §17.20.030.F.2 ADU standards do not impose an owner-occupancy condition either — an earlier version of this entry incorrectly attributed an owner-occupancy bar to NRS 278.257; that claim has been removed as unsupported by the statute's text

  • Plans must comply with 2024 IRC with Southern Nevada amendments
  • Automatic fire sprinkler system required (permits issued on or after January 5, 2026 per Ord. 3256) — NOTE: NRS 278.257 Sec. 3(b) exempts ADUs from commercial fire-sprinkler codes; the NLV residential sprinkler requirement under IRC/Ord. 3256 applies to residential units; confirm with Building Safety

Sign Permit

Verified

Required for the erection, installation, repair, or relocation of most permanent and temporary signs in the City of North Las Vegas, per NLV Municipal Code Title 17 §17.24.150 (Signs). Signage is reviewed by the Building Department using a dedicated Sign Permit Application; valuation (and permit fee) is based on the signed contract price (material, labor, and manufacturer's costs), consistent with NLV MC Table 3-F (15.72.280), which lists signs as "provide contract price" rather than a per-square-foot rate. Off-premise signs carry a separate flat $500.00 fee.

Fire Sprinkler System Permit

Verified

A construction permit is required for the installation, modification, or retrofit of any automatic fire sprinkler system in the City of North Las Vegas, per 2024 International Fire Code (IFC) §105.6.1. The permit is reviewed by North Las Vegas Fire Prevention (part of the Division of Building and Fire Safety) against NFPA 13 (2022 edition) and NFPA 25 (2023 edition), plus the North Las Vegas Fire Code (NLV MC Chapter 15.92). This is a separate construction permit from the automatic residential fire sprinkler requirement built into new single-family building permits (Ord. 3256, effective January 5, 2026) — that citywide mandate is documented under the Residential Building Permit entry; this permit type is the sprinkler-system installation permit itself.

Change of Occupancy / Certificate of Occupancy Permit

Verified

Required whenever a building or space in the City of North Las Vegas changes use or occupancy classification — including changes with no physical alterations. Governed by NLV MC §15.72.220 (Certificate of Occupancy) and the 2024 International Existing Building Code (IEBC) Chapter 10 (Partial or Complete change of occupancy). Per NLV's "Policy for Change of Occupancy" submittal checklist, a change-of-use permit is required even when no construction work is proposed, and the Building Safety and Fire Prevention Division must re-inspect the space before a new Certificate of Occupancy is issued.

Requirements

  • Per 2024 IEBC §506.1 and NLV MC §15.72.220.B, no change may be made in the use or occupancy of a building that would place it in a different division of the same occupancy group, or in a different occupancy group, unless the building is made to comply with the code for that division/group
  • All changes in occupancy or use type require submittal of the Change of Occupancy checklist items, even if no physical alterations are being done
  • Prerequisites that must be in place before a building permit application can be accepted: appropriate zoning for the proposed use; any required Special Use Permit, Conditional Use Permit, or Variance already approved; Site Plan Review or Planned Unit Development approval for the site; and compliance with any Planning Commission/City Council conditions of approval
  • Project must comply with 2024 IEBC Chapter 10 for Partial or Complete change of occupancy
  • Complete building and plumbing code analysis required: type of construction (including whether the building is sprinklered), occupancy classification, actual/allowable floor area, height, and stories, exit analysis, fire-resistive requirements, code reference/year, and required vs. provided plumbing fixture counts
  • Where a change of occupancy results in a higher risk category, the building must satisfy 2024 IBC §1609 and §1613 for the new risk category using applicable wind and full seismic forces
  • Accessible access and egress required per 2024 IBC Chapter 10 and applicable Chapter 11 items for the affected area
  • New occupancy classification must comply with 2024 IECC §C505 where the change increases fossil fuel/electrical energy demand or total interior lighting wattage
  • Applications expire 180 days from the date of submittal if permits are not issued
  • Following issuance of the Change of Occupancy permit, a Building Safety and Fire Prevention Division inspection is required before a new Certificate of Occupancy is issued
  • A Temporary Certificate of Occupancy is available (valid 30 days, renewable once for a total of 60 days) if the Building Official finds no substantial hazard from earlier occupancy of a portion of the building
