Codes adopted
Montana adopts a single statewide building code by rule and, by default, enforces it directly — local governments only gain enforcement authority once the state certifies them. Under the Montana Building Codes Act (Mont. Code Ann. Title 50, Chapter 60), the Department of Labor & Industry's Building Codes Bureau adopts one state building code applicable everywhere (§ 50-60-203, codified further at Administrative Rules of Montana Title 24, Chapter 301) — currently the 2021 editions of the IBC, IRC, IMC, IFGC, IECC, IEBC, ISPSC, and UPC, with the 2020 NEC for electrical (effective statewide since 6/11/2022 per the Bureau's own Current Codes page). A city, county, or town may adopt and enforce its own building-code program under § 50-60-301, but its adopted code "may include only codes adopted by the Building Codes Bureau" — a local edition can never diverge from or be less stringent than the state's. Critically, under § 50-60-302, a local government cannot enforce ANY building code — even one it has formally adopted — until the Bureau certifies its program (requiring an approved code, a published fee schedule, an enforcement plan, and properly licensed or nationally certified inspectors); certification is granted per TRADE, not as one blanket designation. The Bureau's own "Certified City, County and Town Programs" list uses the key B=Building, P=Plumbing, E=Electrical, M=Mechanical, SP=Pool, W=Wildland-Urban-Interface — a jurisdiction can be certified for Building only while Electrical/Plumbing/Mechanical remain directly state-enforced within the same city limits (e.g., Havre, Anaconda-Deer Lodge), or certified across all trades (e.g., Billings, Missoula, Great Falls, Bozeman, Helena, Kalispell). Non-certified jurisdictions — most of Montana's unincorporated county land, since very few counties appear on the certified list — fall under direct enforcement by the state Building Codes Bureau (§ 50-60-304). Montana also exempts private homes and buildings of four or fewer dwelling units not serving transient guests from the state building-permit requirement entirely, though electrical, plumbing, and mechanical permits remain separately required regardless. Always confirm with the specific jurisdiction which trades it is certified for versus which remain directly state-enforced.
- Montana has a mandatory statewide building code administered by the Montana Department of Labor & Industry (DLI) Building Codes Bureau, amended by the Administrative Rules of Montana (ARM) Title 24, Chapter 301. Cities, counties, and towns may become 'certified' to locally administer permitting and inspection for all or part of the code (building, plumbing, electrical, mechanical, swimming pool, etc.); non-certified areas/trades — and, where a town's Building certification is itself partial (e.g. residential-only), non-certified project types — fall under direct state administration by the DLI Building Codes Bureau. - West Yellowstone is a Montana DLI-certified jurisdiction for Building (B), RESIDENTIAL ONLY, within town limits — verified directly against the DLI Building Codes Bureau's official 'Montana Certified Local Government Program' roster (PDF, updated 04/22/2026, fetched and text-extracted directly via curl with browser headers after an initial normal-fetch MIME-type rejection): 'West Yellowstone | B (residential only) | Kyle Tanner | 602-4897 | City Limits'. This is the SAME narrower certification pattern as Hardin, MT and Deer Lodge County/Anaconda-Deer Lodge (B, residential only) — NOT the full-trade-set pattern of Manhattan (B, M, P, E, SP). Note: the Town's own Public Services webpage names its Building Inspector/Deputy Superintendent as 'KC Tanner' (ktanner@westyellowstone.gov, (406) 646-7609/640-9074) — this is presumed to be the same individual as the DLI roster's 'Kyle Tanner' (matching surname and role), but the given-name discrepancy (Kyle vs. KC) is reported honestly rather than silently reconciled, since it was not independently confirmed beyond the two source documents.
- COMMERCIAL building permits within West Yellowstone town limits are NOT covered by the Town's residential-only certification and are issued DIRECTLY by the Montana DLI Building Codes Bureau, exactly as in a non-certified jurisdiction. Electrical, Plumbing, and Mechanical/HVAC work — for BOTH residential AND commercial project types — likewise route DIRECTLY to the state DLI Building Codes Bureau, since West Yellowstone holds no certification in those trades at all. Source: Montana DLI Building Codes Bureau certified-jurisdictions roster PDF (updated 04/22/2026, directly fetched and text-extracted).
- The Town of West Yellowstone's own Zoning Permit Process (Commercial) document states explicitly: 'These permits are obtained through the State of Montana Department of Labor and are subject to separate fee schedules. Applicants must provide proof of state building permit and obtain a Town of West Yellowstone Business License.' This independently corroborates the DLI roster's residential-only/state-routed-commercial finding directly from the Town's own published materials. Source: Town of West Yellowstone, Zoning Permit Process-Commercial (PDF), https://www.townofwestyellowstone.com/wp-content/uploads/2026/05/Commercial-Zoning-Permit-fillable.pdf
- The Town's own downloadable Building Permit form ('Building-Permit-FINAL.pdf') is a Town-branded local form, not a reformatted state BCP-1 template (contrast with Hardin), and states on its face: 'Separate permits are required for Electrical, Plumbing, Heating, Ventilating or Air Conditioning' and 'This permit becomes null and void if work or construction authorized is not commenced within 180 days, or if work is suspended or abandoned for a period of 180 days at any time after work is commenced.' Source: Town of West Yellowstone Building Permit (PDF), https://www.townofwestyellowstone.com/wp-content/uploads/2026/05/Building-Permit-FINAL.pdf
- West Yellowstone Municipal Code (WYMC) Title 15, Buildings and Construction, contains Chapter 15.04 'Uniform Codes Adopted' and Chapter 15.08 'Moving Buildings.' The Town's own Application for Mechanical Permit form cites 'Section 15.04.010 WYMC and Section 8.70.105 ARM' as its authority. Section 15.04.010(A) (fetched live via browser 2026-07-16 — codepublishing.com 403s to curl/plain fetch behind a Cloudflare challenge but renders normally in a browser) reads: 'The current editions of the building, mechanical and related codes and all accompanying appendices, amendments and modifications adopted by the Bureau of Building and Measurement Standards, Montana Department of Labor and Industry (or its successor)... shall be adopted by reference through administrative action of the operations manager, as authorized by Section 50-60-301(1)(b), MCA... These codes are applicable to all buildings within the building code enforcement area of the town, including, but not limited to, residential buildings containing less than five dwelling units...' This directly corroborates the Town's local Building (residential-only) certification deferring to state-adopted code editions, and resolves a prior review pass's 'honest access gap' note on this chapter — the text was reachable via a rendered browser fetch, not genuinely inaccessible.
- The Town's own Application for Mechanical Permit form (citing WYMC 15.04.010) is a LOCAL Town-branded form with its own printed local fee schedule and 'Building Department, 646-7609' contact — this appears to be a legacy/superseded local mechanical-permit form predating, or inconsistent with, the DLI roster's current listing of West Yellowstone as certified for Building (residential only) ONLY with no Mechanical certification. Because the current, authoritative, dated (04/22/2026) DLI certified-jurisdiction roster is the governing source of truth for this project and does not list West Yellowstone as certified for Mechanical, this dataset treats Mechanical permitting in West Yellowstone as STATE-issued (per the DLI roster), while flagging the Town's own still-published Mechanical Permit form as a discrepancy worth confirming directly with the Town Building Department, (406) 646-7609, before relying on it. Omission of this discrepancy would violate the grounded-data policy, so it is disclosed rather than silently resolved in either direction.
- Statewide adopted codes (Administrative Rules of Montana, Title 24, Chapter 301), applicable both to West Yellowstone's locally-certified residential Building program and to the state-enforced trades and commercial building work: 2021 International Building Code (IBC), 2021 International Residential Code (IRC), 2021 International Existing Building Code (IEBC), 2021 International Mechanical Code (IMC), 2021 International Fuel Gas Code (IFGC), 2020 National Electrical Code (NEC), 2021 Uniform Plumbing Code (UPC), 2021 International Energy Conservation Code (IECC), 2021 International Swimming Pool and Spa Code (ISPSC), ICC A117.1-2017 Accessibility — all effective June 11, 2022. Permit types & fees
Residential Building Permit (New Construction / Addition / Alteration / Repair)
Required for new single-family/residential construction, additions, alterations, and repairs on RESIDENTIAL property within West Yellowstone town limits. Issued by the Town of West Yellowstone under its DLI certification for Building (B), RESIDENTIAL ONLY, reviewed by Building Inspector Kyle/KC Tanner against the state-adopted 2021 IBC/IRC/IECC editions. This certification does NOT extend to commercial building work — see the separate commercial-building-permit-state entry. A separate Zoning Permit is also required.
Zoning Permit
Required for all new construction, additions, renovations, relocation of a structure, or erection of a fence within West Yellowstone town limits. Administered by the Town's Administration Department; commercial projects (including nightly rentals and apartment developments) follow an expanded Commercial Site Plan Review process involving the Development Review Group (DRG), Planning Board, and Town Council.
Commercial Building Permit (State-Issued)
Because West Yellowstone's DLI certification for Building covers RESIDENTIAL work only, any commercial building project within town limits — new construction, addition, alteration — requires a Building Permit/Plan Review Application issued directly by the Montana DLI Building Codes Bureau in Helena, not by the Town, under the 2021 IBC. The Town's own Commercial Zoning Permit process explicitly requires proof of this state building permit before issuing its local Zoning Permit and Business License.
Electrical Permit (State-Issued)
Because West Yellowstone holds no DLI certification in Electrical (only a residential-only Building certification), electrical work anywhere within town limits — residential or commercial — requires a Residential, Homeowner, or Commercial Electrical Permit issued directly by the Montana DLI Building Codes Bureau in Helena, not by the Town, under the 2020 NEC. The same statewide BCP-1 fee schedule already documented for Anaconda-Deer Lodge and Hardin applies.
Plumbing Permit (State-Issued, incl. Water Heater)
Because West Yellowstone holds no DLI certification in Plumbing (only a residential-only Building certification), plumbing work anywhere within town limits — including water heater installation/replacement, residential or commercial — requires a Plumbing Permit issued directly by the Montana DLI Building Codes Bureau in Helena, not by the Town, under the 2021 Uniform Plumbing Code. The same statewide BCP-1 fee schedule already documented for Anaconda-Deer Lodge and Hardin applies.
Mechanical / HVAC Permit (State-Issued)
Because West Yellowstone's current DLI certification covers Building (residential only) and does NOT include Mechanical, mechanical/HVAC work anywhere within town limits — residential or commercial — is treated in this dataset as requiring a Mechanical Permit issued directly by the Montana DLI Building Codes Bureau in Helena, under the 2021 International Mechanical Code and International Fuel Gas Code, using the same statewide BCP-1 fee schedule already documented for Anaconda-Deer Lodge and Hardin. NOTE: the Town of West Yellowstone also still publishes its own local 'Application for Mechanical Permit' form (citing WYMC 15.04.010) with a distinct local fee schedule and 'Building Department, 646-7609' contact — this appears inconsistent with the current DLI roster and should be confirmed directly with the Town before relying on either fee schedule.
Solar Panel Permit (State-Issued Electrical/Alternative Energy Permit)
West Yellowstone's DLI certification covers Building (B), residential only — the Town holds no Electrical certification at all, so solar installations (which Montana's statewide system permits through the electrical/alternative-energy track, not a distinct 'solar building permit') route directly to the Montana DLI Building Codes Bureau in Helena, the same as any other West Yellowstone electrical work (see electrical-permit-state). There is no separate 'solar permit' fee category in Montana's state system: solar is permitted through a Residential/Commercial Electrical Permit (if a licensed contractor performs the whole job) or an Application for Alternative Energy Permit (if a non-electrician installer does the panel work, with a licensed contractor required only for the final grid-tie connection). This is the same statewide mechanism already documented and verified for unincorporated Yellowstone County (see solar-panel-permit in that file) and applies identically here because West Yellowstone, like that county, has no local electrical certification of its own.
EV Charger Installation (State-Issued Electrical/Alternative Energy Permit)
West Yellowstone's DLI certification covers Building (B), residential only — the Town holds no Electrical certification at all, so EV charging station (EVSE) installations, like solar, route directly to the Montana DLI Building Codes Bureau in Helena for the electrical work, the same as any other West Yellowstone electrical permit (see electrical-permit-state). Montana's state Building Codes Bureau permits a Level 2 or DC fast charger circuit through a standard Residential or Commercial Electrical Permit (BCP-1) — there is no separate statewide 'EV charger permit' fee category, consistent with the same statewide mechanism already documented for solar-pv-permit in this file.
Sign Permit
Required for installation of any sign (ground, wall, window, canopy/awning, projecting, or directional) on commercial, church, office, school, or other property within West Yellowstone town limits. Administered by the Town via its own Application for Sign Permit — a genuinely active, tourism-driven commercial district (hotels, restaurants, gift shops along the Central Business and Expanded Business Districts) makes this a real, regularly-used local process, not a formality. Signs extending over a public right-of-way require additional insurance/bonding information.
Fire Sprinkler & Fire Alarm Systems (No Distinct Permit Product)
West Yellowstone has NO standalone 'fire sprinkler permit' or 'fire alarm permit' — this was actively chased, not assumed. Montana's DLI Building Codes Bureau does not certify a distinct 'Fire' trade at all: the certified-jurisdictions roster's trade columns cover only Building (B), Plumbing (P), Electrical (E), Mechanical (M), Swimming Pool (SP), and Wildland-Urban Interface (W) — West Yellowstone is listed only for 'B (residential only)'. The Bureau's own permit-applications index likewise lists only Boiler, Building, Electrical, Elevator, Factory-Built Buildings, Mechanical, and Plumbing permit categories — no Fire Sprinkler or Fire Alarm permit exists among them. The separate Montana Fire Protection License Program (a DLI professional-licensing board) licenses fire-protection CONTRACTORS/installers but does not itself issue installation permits or conduct plan review. In practice, fire suppression/alarm work in West Yellowstone is reviewed through two existing channels already documented in this file: (1) for new commercial construction or alteration, as part of the state DLI Commercial Building Permit's plan review under the adopted 2021 IBC (see commercial-building-permit-state); and (2) as one checklist line item ('Fire Suppression') within the Town's own Commercial Site Plan Review process bundled into the Zoning Permit (see zoning-permit). No independent Town Fire Department or fire-district fee schedule for sprinkler/alarm plan review was found published online after an exhaustive search.
Change of Use / Occupancy (via Business License Application)
West Yellowstone has no separately named 'Change of Use Permit' or 'Certificate of Occupancy' application — this was actively chased, not assumed. A change in commercial tenant, business use, ownership, or location is instead administered through the Town's Business License process (WYMC Chapter 5.04): the applicant checks New Business, Transfer of Ownership, Change of Location, or Name Change on the Business License Application, provides required fire and health inspection documentation (WYMC 5.04.020), a parking site plan (or certification of parking in-lieu payment), and, for Grizzly Park properties, Grizzly Park Architectural Committee (GPAC) approval. Completed applications are approved or denied by the Town Council at its next regularly scheduled meeting (Town Council meets the 1st and 3rd Tuesday of each month) unless the Planning Board needs additional time to review the parking plan (WYMC 5.04.030(B)) — EXCEPT a same-nature/same-location ownership Transfer, which the Town Clerk can instead process administratively upon fee payment and an internal parking-plan review (WYMC 5.04.030(C)), without waiting for a Town Council meeting. Separately, Montana's own state Building Permit rules are explicitly triggered by 'a change of occupancy' for non-exempt buildings outside a local government program's jurisdiction, per the DLI Building Codes Bureau's own Building Permit FAQ — so a change of use accompanied by construction/remodeling of a West Yellowstone commercial building also requires the state Commercial Building Permit already documented in commercial-building-permit-state.

Tips & gotchas
- West Yellowstone is a Montana DLI-certified jurisdiction for BUILDING (B), RESIDENTIAL ONLY — verified directly against the DLI Building Codes Bureau's own 'Montana Certified Local Government Program' roster PDF (updated 04/22/2026, fetched via curl with browser-set Accept headers after the plain WebFetch tool failed to render the binary PDF): 'West Yellowstone | B (residential only) | Kyle Tanner | 602-4897 | City Limits'. This matches the narrower Hardin/Deer-Lodge-County pattern (B, residential only), NOT Manhattan's full-trade-set (B, M, P, E, SP) pattern.
- COMMERCIAL building permits, and ALL Electrical/Plumbing/Mechanical permits (residential or commercial), route DIRECTLY to the Montana DLI Building Codes Bureau in Helena — confirmed both by the DLI roster AND, independently, by the Town's own Zoning Permit Process-Commercial document, which states these permits 'are obtained through the State of Montana Department of Labor and are subject to separate fee schedules.'
- NAME DISCREPANCY, disclosed rather than resolved: the DLI roster lists the certified building official as 'Kyle Tanner'; the Town's own Public Services page names its Building Inspector/Deputy Superintendent as 'KC Tanner' (ktanner@westyellowstone.gov). Likely the same person (same surname, same role, same town), but this was not independently confirmed.
- DOCUMENTED DISCREPANCY, disclosed rather than resolved: the Town of West Yellowstone still publishes its own local, Town-branded 'Application for Mechanical Permit' (citing WYMC 15.04.010 and ARM 8.70.105) with its own printed local fee schedule and a 'Building Department, 646-7609' contact — this appears inconsistent with the current DLI roster's listing of West Yellowstone as certified for Building (residential only) ONLY, with no Mechanical certification. This dataset defers to the dated, authoritative DLI roster (Mechanical = state-issued) but flags the Town's still-published local form for direct confirmation before an applicant relies on it.
- The Town's own Building Permit form explicitly states: 'Separate permits are required for Electrical, Plumbing, Heating, Ventilating or Air Conditioning' — directly corroborating that those trades are NOT covered by the Town's Building Permit and (per the DLI roster) route to the state.
- West Yellowstone Municipal Code (WYMC) Title 15 (Buildings and Construction) contains Chapter 15.04 'Uniform Codes Adopted' and Chapter 15.08 'Moving Buildings' — confirmed live via the Town's codepublishing.com pages (2026-07-16). The site returns HTTP 403 to curl/plain fetch (Cloudflare WAF challenge) but renders normally in a browser; a prior review pass treated this WAF block as an access gap and cited Wayback snapshots instead of the live pages — the live pages, including the 15.04.010 code-adoption text itself, are directly readable via browser and are cited as the live originals here.
- No online fee schedule with dollar amounts exists for the Town's own Building Permit or Zoning Permit: both forms print a fee-line-item block or a 'contact Town Offices for fee information' instruction rather than fixed dollar figures. Every relevant fees[] entry's amount is intentionally null (not fabricated) — call (406) 646-7609 (Building) or (406) 646-7795 (Public Services/Zoning) for current figures.
- Electrical, Plumbing, and (per the current DLI roster) Mechanical permits in West Yellowstone use the SAME statewide BCP-1 fee schedules already documented for Anaconda-Deer Lodge and Hardin in this dataset — these are not West Yellowstone-specific fees, but they are the correct, currently-published statewide fees that would apply to state-issued work there.
- reviewTimelineDays is null/unverified for every permit type in this file except the Commercial Building Permit (State-Issued), which correctly borrows the DLI's own published '2-3 weeks' governing figure for state-administered commercial building review — the same standard applied consistently to Hardin's commercial-building-permit-state entry elsewhere in this dataset.
- Census: West Yellowstone town, Gallatin County, Montana — state FIPS 30, place FIPS 79525, county FIPS 031, per U.S. Census Bureau Boundary and Annexation Survey (BAS26) materials and the Montana County/Place FIPS reference files.
