Development Permit (Town Zoning & Floodplain Compliance Review)

Required by the Town of Edgewood Planning & Zoning Official Administrator before any building, structure, land use, or Manufactured Home installation begins within Town limits, and BEFORE an applicant may apply to the state Construction Industries Division (CID) for a State Building Permit. Reviews zoning and National Flood Insurance Program (floodplain) compliance and may trigger Technical Advisory Committee (TAC) review.

Requirements

  • No building, structure, or land use may commence within the Town of Edgewood without Planning & Zoning Official Administrator review and sign-off (Zoning Ordinance 2024-017 §8.A)
  • Development Permit applications must receive zoning and Flood Plain compliance review and signature BEFORE applying to CID for the State Building Permit
  • Site development plan required, showing: a scaled map of boundaries/buildings/structures/land uses (existing and proposed) and driveway location/dimensions (driveways must be at least 14' wide, with a turn-around or hammerhead if 150' or longer); location/dimensions of contiguous streets, utility easements, septic system/leach field, and parking/loading areas; a description of natural features (topography, vegetation) and any special drainage or flood-plain conditions; a description of buildings/structures on contiguous lands; and an exterior lighting plan if applicable (§8.B)
  • Development Permits are issued only for stick-built buildings, manufactured buildings, or mobile homes in qualifying commercial/mixed-use/light-industry/special-use zones — NOT for shipping containers, sheds, carports, trailers, semi-trailers, or RVs used as alternative commercial structures (§8.F)
  • For residential structures, Development Review approvals are issued only for IRC-compliant buildings or NM Manufactured Housing Division-approved manufactured homes — not shipping containers, sheds, carports, trailers, semi-trailers, or RVs outside an approved RV park (§8.E)
  • Elevation Certificates required for all structures built or placed in the Town's designated flood plain
  • Permit expires within one year of approval; forfeited if construction is not initiated within six months or work stops for more than 90 days without documented justification (§8.D)

State Building Permit (NM Construction Industries Division)

Verified

The actual building permit for new construction, additions, alterations, repairs, or demolition within the Town of Edgewood, issued by the New Mexico Regulation & Licensing Department's Construction Industries Division (CID) rather than by the Town, because Edgewood has not been designated a CID Local Enforcement Agency (LEA). Applicants must first obtain the Town's Development Permit zoning/flood-plain sign-off (see the development-permit entry above) before CID will accept the State Building Permit application.

Requirements

  • Town of Edgewood zoning and flood-plain compliance sign-off (Development Permit) obtained BEFORE applying to CID, per Zoning Ordinance 2024-017 §8.A and CID's own Building Permit Guide ('You must obtain zoning approval and signature on the APPLICATION for STATE BUILDING PERMIT before applying to this office for the building permit')
  • Complete the APPLICATION for STATE BUILDING PERMIT, listing property owner, contractor (license number if applicable), architect (if applicable), project address, legal description, scope of work, and total square footage
  • Two complete sets of plans (minimum 1/4"=1'-0", on at least 11"x17" paper): Site Plan, Foundation Plan, Floor Plan, Floor & Roof Framing Plans, construction Details (wall sections, footing/foundation, energy-code compliance), and a total square footage breakdown (heated/garage/carport/porch/patio)
  • A signed contract between owner and contractor is required for project valuation; homeowner-permit applicants get their valuation calculated by CID from its own tables (NMAC 14.5.5.10)
  • Homeowners applying for a Homeowner Construction Permit must sign and notarize the Homeowner's Responsibilities Form; a homeowner permit cannot be used where a GB-2/GB-98 licensed contractor is acting as general contractor
  • A separate septic permit (from the NM Environment Department) is required if the project needs an individual liquid-waste system
  • Plans for steel-stud/structural-steel/steel-pipe construction, prefabricated/premanufactured/component structures, wood foundations, retaining walls over 4 feet, second-story additions, or alternate materials/methods must be prepared and sealed by a NM-registered architect or structural engineer
