Accessory Dwelling Unit (ADU) Permit & Rental License

Verified

  • Permitted only in owner-occupied single-family dwellings; either the ADU or the principal residence must be occupied by the property owner
  • No more than one ADU per lot
  • Detached ADUs barred on lots under 10,000 sq ft; no minimum lot size for internal/attached ADUs
  • Detached ADUs capped at 1,200 sq ft; no maximum size for internal/attached ADUs
  • Detached ADU height: minimum 10 ft, maximum 19 ft (up to 24 ft for a pitched roof or 20 ft for a flat roof, with side/rear setbacks increased 1 ft per additional foot of height above 17 ft)
  • Must include a kitchen and sanitation facilities (at least a 3/4 bathroom) separate from the main dwelling
  • At least one additional off-street parking space beyond that required for the primary residence; not located in a front-yard setback
  • Single utility meter per service, in the property owner's name
  • May never be used as a short-term rental (rented under 30 days)
  • A Rental Dwelling Business License is required if the owner receives any monetary compensation for the ADU, and cannot be granted without evidence of a Certificate of Occupancy
  • Inspections required for compliance with building, fire, and health/safety codes before approval, per UCA § 10-9a-511.5
