The State Building Code is in effect in every county and city in Washington, and its minimum performance standards may not be diminished locally.   • Washington State Energy Code — adopted under Chapter 51-11 WAC.
  • International Property Maintenance Code — adopted in Title 17 and locally amended at BMC § 17.04.110.
  • RCW 19.27 — the Washington State Building Code. Bremerton's adoption is expressed as taking the state codes "together with any additions, deletions, and exceptions currently enacted or as may be amended from time to time by Washington State through its Building Code Council (WSBCC) pursuant to the Washington Administrative Code ("WAC"), and as further amended in this chapter, are adopted by reference".

Tips & gotchas

  • THE CITY CODE BEATS THE STATE CODE IN A CONFLICT HERE, within what state law allows — BMC § 17.04.030. That is the opposite of what most people assume.
  • Six of the adopted codes carry named Bremerton amendments. The published International text is not the operative text.
  • Each code sits under its own WAC chapter, so "which state amendments apply" has a different answer for a house, a shop and a plumbing job.
  • Fee AMOUNTS are not in Title 17. BMC § 17.04.130 sends you to BMC § 3.01.040, Community Development - Rate Table C — ask the city for the current table.
  • An appeal to the Hearings Examiner cannot reinterpret the administrative provisions or waive a requirement (BMC § 17.04.140).
