Residential Building Permit (New Construction / Addition / Alteration / Repair) in Libby, Montana
Required for new single-family home construction, additions, alterations, and repairs within Libby city limits. When you need this permit
- Complete the Libby Building Permit Application: project location, owner/contractor/designer/electrician/plumber contact information, type of project (Residential, New/Addition/Alteration/Repair/Move/Demolition), description of the nature of the project, and estimated total cost (labor and materials)
- Submit one set of drawings/plans and specifications defining the scope, intent, and method of construction, typically including: (A) a site plan showing property lines, location of structures, existing/proposed utilities, parking areas, and adjacent streets/alleys; (B) floor plans showing use and relationship of spaces, sizes, doorways, windows, fixtures, stairways, and handicapped-accessible features if needed; (C) a section view through the building detailing size/type of materials and assembly method; (D) additional information may be required for commercial and multi-family structures or unusual/hazardous structures
- Since January 23, 2012, all new building permits must also be reviewed and signed off by the Lincoln County Floodplain Manager; if the property lies in a FEMA-regulated floodplain, a separate floodplain permit must be obtained from the County and a detailed floodplain map must accompany the application
- Construction may not begin until fees are paid and the permit is issued; separate electrical, plumbing, and mechanical permits issued by the State of Montana are required for all such work
- A Certificate of Occupancy must be issued before the building can be used

Inspection process

Foundation Inspection
To be made after the footings are poured and any required forms for foundations are in place. Per City of Libby Inspection Record card.

Concrete Slab or Underfloor Inspection
To be made after all in-slab service equipment is in place but before any concrete is poured, or after all service equipment is installed in a crawlspace.

Frame Inspection
To be made after the roof, all framing, fire blocking, and bracing are in place; all vents, chimneys, ductwork, and piping are in place; rough-in plumbing and rough-in electrical must be approved.

Energy Conservation Inspection
To be made after all air barriers, ceiling and wall insulation, floor insulation or crawlspace insulation, HVAC, and basement insulation are installed.

Gypsum Board Inspection
To be made after all gypsum board is in place but before any plastering is applied to joints and fasteners.

Final Inspection
To be made after the building is substantially completed and ready for occupancy; a Certificate of Occupancy is required before the building can be used. Per the City's Inspection Record card, the adopted code requires the permit holder to notify the building official when work is ready for inspection.

Tips
- The City's Inspection Record card and Appendix L fee table in the current public-facing packet still cite 2009 IBC/IRC and 2006 IRC edition numbers respectively, even though the statewide code now in force is the 2021 edition — call the Building Inspector at (406) 291-9629 to confirm current applicable figures before finalizing a budget.
- Since January 23, 2012, the Lincoln County Floodplain Manager must review and sign off on all new building permits; if your property may be in a FEMA floodplain, submit a Floodplain Zone-Details Request Form to Lincoln County Emergency Management early — determinations take up to 15 working days and there are no same-day determinations.
- Separate electrical, plumbing, and mechanical permits are always required from the State of Montana DLI Building Codes Bureau (not the City) for any Libby project, since the City is not certified in those trades.
- Sheds/playhouses under 120 square feet, fences under 6 feet, retaining walls under 4 feet, sidewalks/driveways, and finish work (painting, tiling, carpeting, cabinets/countertops) do not require a City building permit.
