Codes adopted
Idaho adopts a statewide baseline building code set under the Idaho Building Code Act (Idaho Code Title 39, Chapter 41) and IDAPA rules administered by the Idaho Division of Occupational and Professional Licenses (DOPL). Effective January 1, 2021, the statewide baseline includes the 2018 International Building Code (IBC), 2020 Idaho Residential Code (based on the 2018 IRC Parts I–III and IX with Idaho amendments), 2020 Idaho Energy Conservation Code (based on the 2018 IECC with Idaho amendments), 2018 International Existing Building Code (IEBC), 2018 International Mechanical Code (IMC), 2018 International Fuel Gas Code (IFGC), and 2018 International Fire Code (IFC). The National Electrical Code is adopted separately by the Idaho Electrical Board (IDAPA 24.39.10), not bundled with the building code: Idaho enforces the 2023 NEC, effective July 1, 2024 (the state used the 2017 NEC with amendments before that and skipped the 2020 edition). Local jurisdictions must enforce the state baseline and may adopt amendments only where those amendments are at least as stringent as the state-adopted editions; local amendments may not be less restrictive. Enforcement is local — each city or county issues permits and performs inspections. Always confirm the current adopted edition and any local amendments with your specific jurisdiction before submitting plans.

Permit types & fees
Residential Building Permit (New Construction / Addition / Alteration)
Required for new single-family dwellings, additions, alterations affecting weight-bearing walls or window sizing, garages/shops, pole buildings, decks, and most other residential structures over 120 sq ft in unincorporated Gem County. Governed by the 2018 IRC as enforced under Gem County Code Title 9. Applications are submitted in person/by mail to the Development Services Building Department; plans are reviewed by the Building Official.

Gem County does not publish a distinct residential solar/rooftop-PV permit; a standard roof-mounted panel installation typically does not itself trigger a county building permit (it is not a weight-bearing wall or window-size alteration), but the electrical interconnection work is regulated statewide by the Idaho Division of Occupational and Professional Licenses (DOPL) / Idaho Electrical Board — NOT Gem County — the same as all other electrical work in the county per the county's own Building FAQs. Commercial/utility-scale ground-mounted solar electricity-generating facilities are a distinct, separately-regulated zoning use under Gem County Code (GCC) 11-6-5(M).

No county building permit is triggered unless the installation involves new structural construction (e.g., a new carport or garage). Tips & gotchas
- Electrical, plumbing, and HVAC/mechanical permits and inspections in unincorporated Gem County are issued entirely by the Idaho Division of Occupational and Professional Licenses (DOPL) (DBS), NOT the county. Electrical: 208-334-2183. Plumbing/HVAC: 208-334-3442. The county's own framing and final inspections will not pass without posted DBS green approval stickers.
- As of July 3, 2023, a Southwest District Health permit approving the site plan is required for ALL building permits — not only those involving septic or plumbing work. Contact SW District Health at 208-365-6371 (1008 E. Locust Street, Emmett).
- Freestanding stick-built structures 120 sq ft (10'x12') or less, cosmetic remodels not touching weight-bearing walls or window sizes, retaining walls under 4 feet, re-siding, and painting do NOT require a building permit.
- Published plan-review timeline is explicitly framed for residential-only: the Building Official has up to 30 days by policy, but 'in most cases, it only takes a few days to a week' (Gem County Building FAQs). No equivalent published figure exists for commercial/industrial permits.
- Agricultural structures use a separate $130 Agricultural Zoning Compliance Permit (5+ acres, agricultural zone, strictly agricultural use) rather than the standard building permit — structures with facilities, offices, or riding arenas do not qualify for the flat rate.
- Contractor Idaho state registration (not a license) is required only when material + labor costs exceed $2,000; homeowners performing their own work are exempt.
- Building permits expire if work has not commenced within 120 days of issuance, or is suspended/abandoned for 120 days.
- Inspections require 12-24 hours' advance notice via the inspection line (208-365-4743); talk to an inspector directly at 208-477-7062.
- Driveways over 150 feet require a driveway construction plan submitted to the Rural Fire District covering the property, in addition to the Road & Bridge (county roads, 208-365-3305) or ITD (state highways, 208-334-8000) access permit.
- Hillside building sites (10%+ slope) or sites on fill material require stamped engineering plus independent-firm compaction test reports.
- Gem County's Scam Alert: all application fees are paid at time of submittal; the county does NOT require further payment prior to hearings and does NOT accept online payments or wire transfers — all payments must be made in person.
- New impact fee schedule (Road and Bridge, Sheriff, EMS, fire district components — rates vary by GCFD#1, GCFD#2/Eagle Fire, or Middleton Fire District) took effect July 15, 2026.
- Office hours vary by day and the office is closed Thursdays (until further notice, for Land Use Code update work) — call ahead, especially since the office may also close intermittently as of January 5, 2026.
