Codes adopted

Colorado has no statewide-mandated building code edition. Under the Colorado Constitution's home-rule provisions (art. XX, home rule for municipalities since 1902; home rule for counties since 1970), building codes and zoning are an enumerated home-rule charter power, so cities and counties adopt and amend their own construction codes independently — predominantly the I-Codes, with editions and local amendments varying by jurisdiction. The one statewide floor is for energy: HB22-1362 (2022) created the Energy Code Board (jointly appointed by the Colorado Energy Office and the Department of Local Affairs) and requires that, on or after July 1, 2023 and before July 1, 2026, any municipality or county that adopts or updates a building code must adopt and enforce an energy code achieving performance equivalent to or better than the 2021 IECC together with the board's Model Electric Ready and Solar Ready Code (which includes electric-ready, EV-ready, and solar-ready provisions); from July 1, 2026 onward the floor shifts to the board's Model Low Energy and Carbon Code or an equivalent. Electrical and plumbing permitting defaults to the Colorado State Electrical Board and State Plumbing Board (within DORA's Division of Professions and Occupations) — the state issues permits and inspects statewide except in counties/jurisdictions that operate their own certified Electrical or Plumbing Inspection Program, in which case the local program has authority instead. Tips & gotchas

  • Lyons runs its own Planning and Building Department, with day-to-day permit processing, plan review, and inspections contracted to SAFEbuilt — Boulder County's own unincorporated Building Division does not issue permits within Town limits. Direct routine permit questions to SAFEbuilt (970-545-3512 / 970-545-3555) and policy/zoning questions to the Town's Planning and Building Director (303-823-6622 ext. 25).
  • As of this file's verification date (2026-07-06), the Town's own published Adopted Codes flyer and Building Department page still describe the 2021 ICC series/2023 NEC as current, even though a 2024 ICC series and the State of Colorado Wildfire Resiliency Code were both slated to take effect July 1, 2026 (5 days prior). Confirm directly with SAFEbuilt whether the 2024 series and Wildfire Resiliency Code are operationally live before finalizing any code analysis for a current application.
  • Electrical and plumbing permits in Lyons are NOT locally licensed trades — the Town/SAFEbuilt verifies your existing Colorado DORA Electrical/Plumbing Board license contemporaneously (per SB19-156/HB19-1086), rather than running its own certified trades exam or license program. Out-of-town contractors need only their active state license plus Town registration, not a separate local trade exam.
  • Lyons' Town of Lyons Contractor License carries a $50 fee, but contractors holding a current Colorado state Electrical or Plumbing license are exempt from that local fee for their respective trade.
  • Every building permit in Lyons carries TWO layered use taxes calculated the same way — (valuation x 45%) x 1.185% for Boulder County Open Space & Recycling, and (valuation x 45%) x 3% for Park Fund/General Fund — plus, for new residential construction, a $2.20/sq ft Park Tax on new living space (including basements) and a St. Vrain Valley Schools Fair Contribution Fee per unit. Budget for all of these on top of the base permit fee and 65% Plan Review Fee; they are easy to underestimate from the base fee schedule alone.
  • Many common residential scopes (furnace/AC replacement, re-roof, water heater, sprinkler system, siding/window replacement, fence over 6 ft, demolition, water/sewer line replacement) are billed at a flat $135 'Single-Unit Residential One Stop' fee rather than the valuation-based schedule — a $70 re-inspection fee applies to any of these if a re-inspection is needed.
  • ADUs in Lyons are unusually permissive versus many peer Colorado mountain-town jurisdictions: no owner-occupancy requirement, no deed restriction, no off-street parking requirement, and NO water tap/sewer tap/electric community investment fees — but short-term rentals (under 30 days) are explicitly prohibited in an ADU.
  • All new and replacement fences will require a building permit starting July 1, 2026 specifically to confirm Wildfire Resiliency Code compliance — fences within 8 ft of an occupied structure must be noncombustible, ignition-resistant, or vinyl (wood is allowed only beyond 8 ft), and are capped at 4 ft in a front-yard setback / 6 ft elsewhere.
