Change of Use / Special Use Permit in Silver Cliff, Colorado
Silver Cliff's Municipal Code has no permit literally titled 'Change of Use Permit'; the functional equivalent is the Special Use Permit established by Title 16, Chapter 8, Sections 16-8-10 through 16-8-30, which is 'required to allow the property owner a use of his or her property that is not specifically stated under the permitted uses for which the property is zoned' (Sec. 16-8-10(a)). Applications are reviewed by the Planning Commission, which forwards a recommendation to the Board of Trustees for final approval or denial.

When you need this permit
- A special use permit is required for any property use not specifically listed as a permitted use for that zoning district (Sec. 16-8-10(a))
- Granted initially for a one-year period; comes before the Board of Trustees every January for renewal review, with a nonrefundable renewal review fee set on the Town's Fee Schedule (Sec. 16-8-10(b), 16-8-20(f))
- If the special use requires new construction or alteration of an existing structure, a building permit must also be obtained; failure to obtain one renders the special use permit null and void (Sec. 16-8-10(c))
- If construction has not begun within the time specified in the building permit and the property changes ownership, the special use permit becomes null and void and the new owner must come before the Board of Trustees with a new proposal (Sec. 16-8-10(d))
- Application is presented to the Zoning Enforcement Officer with the documentation listed on the application/checklist, plus the nonrefundable special use permit fee set on the Town's Fee Schedule (Sec. 16-8-20(a))
- A Planning Commission meeting is scheduled to review the application and make a recommendation to the Board of Trustees; notice is posted at the official Town posting place at least 24 hours before the meeting, with a public hearing/comment opportunity at both the Planning Commission and Board of Trustees meetings (Sec. 16-8-20(b)-(c))
- Nine enumerated approval criteria apply, including harmony/compatibility with the surrounding neighborhood, consistency with the Town's comprehensive plan, avoidance of over-intensive land use, adequate community facilities/services, no undue traffic congestion, no significant air/water/noise pollution, adequate landscaping/buffering/screening, and no detriment to public health/safety/welfare (Sec. 16-8-20(d))
- Following Planning Commission review, the application is placed on the agenda for the next regular Board of Trustees meeting for final approval or denial; an approved permit is issued as a special use permit approval certificate (Sec. 16-8-20(e)-(f))
- A separate, additional application and fee (which may differ from the standard special use permit fee) applies specifically to mining and mining-related uses, including mandatory submission to the Colorado Geological Survey for review at the applicant's cost (Sec. 16-8-30)

- Silver Cliff's code doesn't use the phrase 'change of use permit' — the equivalent mechanism is the Special Use Permit (Title 16, Chapter 8), required whenever a property owner wants to use their property for something not specifically listed as a permitted use in that zoning district.
- A special use permit is only good for one year initially and comes up for Board of Trustees renewal review every January — budget for the nonrefundable renewal fee and don't assume a one-time approval is permanent.
