Change of Use / Change of Occupancy Permit in Center, Colorado

The Town of Center has a directly codified change-of-use requirement. Town of Center Municipal Code Sec. 44-211(a), in Article 44-X (Administration and Enforcement) of Chapter 44 Zoning, current through Ord. No. 571 enacted 4-23-2024, states that 'every application for a Building Permit for construction, moving, alteration, or changes in the type of use or type of occupancy shall be accompanied by' a written statement and scaled plans showing, among other things, 'the existing and intended use of the plot and all structures upon it.' That requires a Building Permit for a change in the type of use or occupancy independent of whether any physical construction accompanies it. Note that the Town's combined Building Permit Application has no dedicated 'Change of Use' checkbox among its listed project types (New Construction, Additions, Mobile Home, Fence New/Replace, Deck or Patio, Reroof, Shed, Siding or Stucco, New Water/Gas/Sewer Tap, Other), so a pure change of use is filed under 'Other' even though the legal obligation is codified in Sec. 44-211(a) itself.
