Codes adopted

Idaho adopts a statewide baseline building code set under the Idaho Building Code Act (Idaho Code Title 39, Chapter 41) and IDAPA rules administered by the Idaho Division of Occupational and Professional Licenses (DOPL). Effective January 1, 2021, the statewide baseline includes the 2018 International Building Code (IBC), 2020 Idaho Residential Code (based on the 2018 IRC Parts I–III and IX with Idaho amendments), 2020 Idaho Energy Conservation Code (based on the 2018 IECC with Idaho amendments), 2018 International Existing Building Code (IEBC), 2018 International Mechanical Code (IMC), 2018 International Fuel Gas Code (IFGC), and 2018 International Fire Code (IFC). The National Electrical Code is adopted separately by the Idaho Electrical Board (IDAPA 24.39.10), not bundled with the building code: Idaho enforces the 2023 NEC, effective July 1, 2024 (the state used the 2017 NEC with amendments before that and skipped the 2020 edition). Local jurisdictions must enforce the state baseline and may adopt amendments only where those amendments are at least as stringent as the state-adopted editions; local amendments may not be less restrictive. Enforcement is local — each city or county issues permits and performs inspections. Permit types

Residential Building Permit (New Construction)

Required for new single-family dwellings, accessory dwelling units, detached garages and shops, sheds, and additions in Eagle. All residential and commercial structures — and appurtenances connected or attached — require a permit for new construction, additions, alterations, relocation, enlargement, replacement, repair, or demolition. Plan review turnaround for single-family homes, ADUs, detached garages/shops, and sheds is currently 6 weeks (high-volume notice published by the Building Division). Applications submitted via the Contractor Portal or in person at 660 E Civic Lane.

Commercial Building Permit (New Construction / Tenant Improvement)

Required for all new commercial and industrial buildings, multi-family dwellings (three or more units), tenant improvements, remodels, and change-of-occupancy projects in Eagle. Governed by the 2018 IBC. Plan review turnaround is currently 6–8 weeks (high-volume notice published by Eagle Building Division). Design Review approval from Planning & Zoning is required before applying for commercial permits. Applications submitted via the Contractor Portal or in person.

Electrical Permit

Required for all electrical installations, alterations, and repairs in Eagle, including new wiring, panel changes, service upgrades, and branch circuit additions. Work governed by the 2023 National Electrical Code (NEC/NFPA 70). Apply through the Eagle Contractor Portal. Payment by check, cash, or credit card; permit issued when paid in full.

Mechanical / HVAC Permit

Required for heating, ventilation, air conditioning, fuel gas piping, and related mechanical installations in Eagle residential and commercial properties. Covers furnaces, A/C, heat pumps, gas fireplaces, gas lines, ductwork, hydronic flooring, and similar work. Governed by the 2018 International Mechanical Code (IMC) and 2018 International Fuel and Gas Code (IFGC). Apply through the Contractor Portal.

Plumbing Permit

Required for plumbing installations, alterations, and repairs in Eagle residential and commercial properties, including water heaters, fixture additions, sewer/water service lines, backflow prevention devices, and lawn sprinklers. Governed by the 2017 Idaho State Plumbing Code (ISPC — IAPMO). Apply through the Eagle Contractor Portal.

Fence and Retaining Wall Permit

Eagle has a tiered fence and retaining wall permit process depending on location (front yard/street, common lot, or other residential). Residential fences in any front yard or along any street require a Fence Permit from Planning & Zoning first; fences over 6 feet or retaining walls over 4 feet also require a building permit from the Building Division. Commercial fences and retaining walls of any height require Design Review. Fences under 6 feet height in other-than-front-yard locations generally do not require a building permit but must comply with Eagle City Code 8-3-3.

Sign Permit

The City of Eagle requires Design Review approval from Planning & Zoning for ALL signs located within Eagle city limits. After Design Review approval and the appeal period, Planning & Zoning issues the sign permit for signs without electrical. Signs with electrical components require a separate electrical permit from the Building Division, which must be obtained before the final sign permit is issued by Planning & Zoning.
