Commercial Building Permit (New Construction / Addition / Remodel / Tenant Improvement) in Hamilton, Montana
Required for new construction, additions, remodels, re-siding, re-roofing, repairs, tenant improvements, and change of use for commercial and industrial buildings in Hamilton. Uses a dedicated Commercial Building Permit Application distinct from the Residential Building Permit Application. Reviewed against the 2021 IBC and related adopted codes by the Planning Department, Public Works, and the Building Official; fire sprinkler and fire alarm plans are submitted as part of this same application rather than a separate fire-department permit (see the Fire Sprinkler / Fire Alarm Permit entry). Change of Use is one of this application's own Proposed Work checkboxes rather than a separate product (see the Change of Use / Certificate of Occupancy entry).

When you need this permit
- New construction, addition, remodel, re-side, re-roof, repair, or change of use of a commercial/industrial structure — checked as 'Proposed Work' on the Commercial Building Permit Application
- Complete, signed permit application including legal description, owner, and contractor information
- Complete, signed site plan checklist
- Two copies of complete construction plan sets plus one digital (PDF) copy
- Energy compliance calculations (ComCheck, energycodes.gov/comcheck)
- Plan sets must be complete at submittal — the City does not accept deferred submittals
- Plan set must include: general information/cover sheet, site plan (utilities, water & sewer service, grading, drainage, site improvements), architectural plans, structural plans, energy calcs, electrical plan with load calculations, plumbing plan, and mechanical plan
- A Montana Professional Engineer or Montana registered Architect stamped set of plans is required for new commercial buildings and additions, projects with structural alterations, interior alterations with an occupancy change, Group A/E/F/H/I/R-1/R-2/R-4 occupancies, mixed-occupancy projects other than R-3 and U, and several other listed triggers
- Fire sprinkler/fire alarm layouts and specs are included in the plan set 'if applicable,' and the Plot Plan/Site Accessibility Plan must show fire riser room, hydrant locations, and water main size
- Submittals routed to Planning, Zoning, Public Works, and the Building Official for approval
- Detached structures require separate permits; electrical, plumbing, and mechanical work each require their own separate permit

Fee schedule
No valuation-based Building Division fee table for commercial construction was found published. Show full citationHide
No valuation-based Building Division fee table for commercial construction was found published. The Commercial Building Permit Application itself (7 pages) has no fee fields anywhere on the form — its office-use section records Construction Type, Occupancy Type, # of Stories, # of Dwelling Units, Max Occupant Load, and Sprinklered Y/N, but no permit-fee or plan-check-fee line. The 2021 Planning & Public Works Fee Schedule (effective April 7, 2021) likewise contains no Building Division valuation-fee table — it covers only Planning/Public Works/Engineering review items. Left null rather than inferring a figure, matching the same unresolved gap already documented on the Residential Building Permit, Change of Use, and Fire Sprinkler/Alarm permit types for Hamilton.City of Hamilton 2021 Planning & Public Works Fee Schedule (effective April 7, 2021), 'Engineering Site Plan Review' section, line item 'Commercial Site Plan Review (up to 3-hours) $150 + $40/hour… Show full citationHide
City of Hamilton 2021 Planning & Public Works Fee Schedule (effective April 7, 2021), 'Engineering Site Plan Review' section, line item 'Commercial Site Plan Review (up to 3-hours) $150 + $40/hour for each hour over 3.' This is a Public Works/Engineering site-plan review fee tied to the site plan checklist required with this application — distinct from, and not a substitute for, a Building Division plan-check fee, which is not published.Review timeline

Tips
- Hamilton's Commercial Building Permit Application is a separate 7-page form from the Residential Building Permit Application, with its own document submittal checklist, plan-sheet-by-plan-sheet requirements, and a longer list of projects that trigger a Montana PE/Architect stamp.
- There is no dedicated Building Division fee table for commercial construction — the only commercial-specific fee found published anywhere on the City's site is the Planning/Public Works 'Commercial Site Plan Review' fee ($150 for the first 3 hours, $40/hour after that), which is not a substitute for a building-permit or plan-check fee. Get a written quote from the Building Department before budgeting.
- Fire sprinkler and fire alarm plans are not a separate city permit — they are submitted as part of this same Commercial Building Permit's document set ('Fire sprinkler/Fire alarm layouts and specs, if applicable'), and the office-use section tracks 'Sprinklered: Y/N.' See Hamilton's Fire Sprinkler / Fire Alarm Permit entry.
- 'Change of Use' is checked as one of the Proposed Work options on this same application rather than requiring a separate form — see Hamilton's Change of Use / Certificate of Occupancy entry for that scope specifically.
- The application's own step-5 instruction prints the inspection-scheduling number as 406-880-3238, which matches neither of the two numbers published elsewhere by the City for inspection scheduling -- Building Inspector Tim Netzley's line, (406) 880-5832, and the Building Department webpage's own posted inspection-scheduling line, (406) 552-3238. Call (406) 552-3238 (the number the Building Department's own webpage publishes for scheduling) if the application's printed number does not connect.
- Electrical, plumbing, and mechanical work each require their own separate permit; the Electrical Permit Application specifically asks commercial projects to include grounding detail, panel/feeder schedule(s), load calculations, and equipment specifications.
