Change of Occupancy (Change of Use) Permit in Parker, Colorado

The Town of Parker's Land Development Ordinance does not have a stand-alone 'Change of Use Permit' procedure. Instead, LDO Sec. 13.01.030(b) makes it 'unlawful to erect, construct, reconstruct, alter, add to, or change the use of any building or other structure... without first obtaining a Building Permit from the Town.' The Building Division processes this as a Building Permit sub-type — Permit Type: COMMERCIAL, Sub-Type: CHANGE OF OCCUPANCY — defined by the Town as 'a change in the occupancy classification'; a new Certificate of Occupancy is issued once approved.

When you need this permit

  • It is unlawful to change the use of any building or other structure without first obtaining a Building Permit from the Town, per LDO Sec. 13.01.030(b)

Tips

  • Parker does not have a separate 'Change of Use Permit' ordinance the way some Colorado municipalities do — a change of use is processed as a Building Permit, Sub-Type: CHANGE OF OCCUPANCY, under LDO Sec. 13.01.030(b), so apply through eTRAKiT's standard commercial Building Permit path and select that sub-type.
  • A change of occupancy can also trigger a separate South Metro Fire Rescue 'Change of Use' fire-safety review and fee ($587.99 total as of SMFR's fee schedule) — budget for both the Town's Building Permit fee and SMFR's review where fire-code-regulated occupancy changes are involved.
