Codes adopted
Idaho adopts a statewide baseline building code set under the Idaho Building Code Act (Idaho Code Title 39, Chapter 41) and IDAPA rules administered by the Idaho Division of Occupational and Professional Licenses (DOPL). Effective January 1, 2021, the statewide baseline includes the 2018 International Building Code (IBC), 2020 Idaho Residential Code (based on the 2018 IRC Parts I–III and IX with Idaho amendments), 2020 Idaho Energy Conservation Code (based on the 2018 IECC with Idaho amendments), 2018 International Existing Building Code (IEBC), 2018 International Mechanical Code (IMC), 2018 International Fuel Gas Code (IFGC), and 2018 International Fire Code (IFC). The National Electrical Code is adopted separately by the Idaho Electrical Board (IDAPA 24.39.10), not bundled with the building code: Idaho enforces the 2023 NEC, effective July 1, 2024 (the state used the 2017 NEC with amendments before that and skipped the 2020 edition). Local jurisdictions must enforce the state baseline and may adopt amendments only where those amendments are at least as stringent as the state-adopted editions; local amendments may not be less restrictive. Enforcement is local — each city or county issues permits and performs inspections. Permit types & fees
Residential Building Permit (New Construction)
Required for new single-family homes, duplexes, townhomes, additions, and accessory structures in Hayden. Reviewed against the City's locally-adopted 2018 IRC and 2018 IECC (Climate Zone 5, effective January 1, 2021) plus City Design Criteria. Applications and construction documents are submitted electronically as PDFs through the BS&A Online portal.
Residential Addition / Remodel / Alteration Permit
Required for additions, remodels, alterations, and accessory structures to existing one- and two-family dwellings in Hayden, reviewed against the locally-adopted 2018 IRC. Additions are valued as a percentage of ICC R-3 valuation depending on whether plumbing is included; remodels are valued at estimated contract price.

Required for heating, ventilation, air conditioning, and gas-appliance installations in Hayden. Unlike electrical and plumbing, mechanical/HVAC permits ARE issued directly by the City of Hayden Building Department using its own itemized Residential Mechanical Worksheet, governed by the locally-adopted 2018 IMC and 2018 IFGC.
Demolition Permit
Required for demolition of an existing structure within Hayden city limits. The City charges a single flat demolition permit fee per its published Fee Schedule.
Accessory Dwelling Unit (ADU) Permit
ADUs are a permit type explicitly listed on the City of Hayden Building Department's own permit-type page, governed by Hayden City Code 11-2-5 (Development Standards Specific to Type of Use). Tips & gotchas
- Hayden is a genuinely separate, incorporated Building Department from Kootenai County Community Development — the county's own Building Division has jurisdiction ONLY over unincorporated Kootenai County and explicitly excludes incorporated cities like Hayden. Do not confuse the two when researching Hayden addresses.
- Unusually among the Kootenai County jurisdictions in this dataset, Hayden issues Mechanical/HVAC permits itself but pushes electrical AND plumbing/sewer permits entirely to the State of Idaho Division of Building Safety (DOPL) — Coeur d'Alene issues all three trades itself, while unincorporated Kootenai County pushes electrical and plumbing to DOPL but keeps mechanical in-house (matching Hayden's split exactly).
- Hayden's own published plan-review timeline is a flat 'up to 1 month,' and importantly RESTARTS at 1 month for every resubmittal after corrections — there is no faster 'completeness check' tier published as there is for Kootenai County's Fast Track program.
