Commercial Building Permit in Elko, Nevada

Required for new multi-family, commercial, and industrial building construction within Elko city limits, reviewed against the 2024 IBC (with Appendices H, J and Q and city modifications, adopted December 9, 2025) and City of Elko Design Standards 2024. Uses the same universal Building Permit Application as all other permit types but has its own dedicated Multi-Family, Commercial and Industrial Submittal Requirement Checklist, requires plans drawn by a Nevada State Registered Architect or Engineer, and routes through Building, Fire, Community Development, Engineering (Drainage & Grading), Planning, and Utilities department approvals — plus outside agencies (Health Department, FEMA, EPA) where applicable. The City on occasion uses an outside consultant for commercial plan check; after initial submittal, applicants deal directly with the consultant until plans are approved.

When you need this permit

  • Plans must be drawn by a Nevada State Registered Architect or Engineer, who is responsible for the design and must date, stamp, and sign each sheet per NRS; a Nevada State Licensed Contractor may draw plans only for their own work (not a client's), with the contractor's company name, state license number, classification, license limit, and preparer's printed name and original signature on the front sheet of each set Contractor
  • Only a licensed contractor of the State of Nevada can be issued a permit for commercial construction — no owner-builder exemption applies (the FAQ's owner-builder provision is limited to owner-occupied single-family dwellings) Owner-builderContractor
  • All submittal documents must be in electronic file format via City-approved transfer methods (searchable PDF, indexed/bookmarked, 3"x3" stamp space on each sheet) per Elko Municipal Code Section 2-1-5(A)-(B); after approval, two physical hard copies of the stamped documents must be provided before the permit is issued (Section 2-1-5(J)(3))
  • For multidisciplinary projects (more than one licensed design profession involved), a design professional in responsible charge must review and approve all submittal documents and act as the point of contact with the building official (Section 2-1-5(F))
  • Complete plans must include architectural, structural, electrical, plumbing and mechanical drawings plus a Code Analysis Sheet covering occupancy group, type of construction, occupant load, address/APN, land use zone, allowable floor area, code editions used, Seismic Design Category, wind loads, snow loads, fire sprinklers/alarms if required, height and number of stories, and exit analysis
  • Structural calculations (vertical and lateral analysis) must be compatible with the plans and wet stamped and signed by the Engineer of Record; soils reports, grading reports and pad certifications are required before pouring of concrete
  • Two sets of civil drawings, properly stamped and signed, including a drainage and grading plan stamped by a registered Engineer/Architect; site plan must show parking layout with handicapped parking and accessible route of travel, landscaping plan, service/loading areas, trash-facility and roof-mounted-equipment screening, and utility locations
  • Storm-water requirements scale with site size: projects 6,000 sq ft to one acre need the City Storm Water Quality Management Program construction-permit and performance-standards checklists plus a SWPPP; projects one acre or more additionally need a copy of the Notice of Intent (NOI) and the state Storm Water General Permit
  • Energy code compliance must be documented via the Prescriptive Method, COMCheck Method, or ASHRAE Method (2024 IECC adopted)
  • Fire protection documentation: fire hydrant locations, fire department access and hook-ups, fire flow calculations (in the civil package), and design details for any fire sprinkler, fire alarm, kitchen protection, standpipe, or smoke control systems
  • A Letter of Approval from the Nevada Health Department (775-753-1138) is required before permit issuance when food preparation is involved
  • Related permits that may also be required: Grading Permit, Street Cut Permit, Air Quality Permit, Storm Water General Permit, and a Will Serve Letter

Inspection process

  1. 1

    Phased Inspections per Approved Permit

Work is subject to inspection at predetermined phases; upon completion of a phase, the permittee may not proceed without the building official's approval, and work must remain accessible and exposed until approved (Municipal Code Section 2-1-8(A)). The Subcontractor of Record form is due before the first inspection. Soils reports, grading reports and pad certifications are required before pouring of concrete per the commercial checklist

  2. 2

Special Inspections / Structural Observation (2024 IBC)

Where the 2024 IBC requires them, special inspections proceed under the City's Special Inspection Agreement and structural observation under the Structural Observation Program form (both published on the Building Forms page)

  3. 3

Final Inspection / Certificate of Occupancy

Building inspected for compliance before a Certificate of Occupancy is issued (Municipal Code Section 2-1-9); the City will not provide water service to a building without a Certificate of Occupancy (Section 2-1-9(D))

Tips

  • There is no separate commercial application form or commercial fee table — commercial projects use the same universal Building Permit Application and Table 1 valuation-based fee schedule as residential. What is distinct is the submittal package: the Multi-Family, Commercial and Industrial Submittal Requirement Checklist, mandatory Nevada architect/engineer stamps, civil drawings, and six-department routing (Building, Fire, Community Development, Engineering Drainage & Grading, Planning, Utilities).
  • Industrial projects — relevant in Elko's mining-hub economy — are explicitly covered by the same Multi-Family, Commercial and Industrial checklist; the City publishes no separate industrial or large-building permitting track. Mine-site facilities outside city limits fall under Elko County's separate building department, not the City.
  • The City on occasion uses an outside consultant for commercial plan check: after initial submittal to the Building Department, applicants and designers deal directly with the consultant until construction plans are approved, and the consultant's charges are billed at actual cost (Fee Schedule Table 2, item 5).
  • The published commercial checklist PDF is dated 'Revised 03/18' and still references the 2018 International Fire Code and paper 'two complete sets' submittals — it predates both the City's electronic-only submittal rule (Municipal Code 2-1-5(A): all submittal documents in electronic format) and the December 9, 2025 adoption of the 2024 code suite. Follow the checklist's content requirements, but submit electronically via the E-Permits portal and design to the 2024 IBC/IEBC/IFC/IECC, 2024 UMC/UPC, and 2023 NEC.
  • Inspection requests must be submitted by 4:00 PM the day before; requests after the deadline are scheduled two business days out (Municipal Code Section 2-1-8(E)).
  • 'Shell only' commercial buildings (exterior envelope complete, interior unfinished) receive a 20% deduction on the mechanical, plumbing, and electrical permit fees per the City's MPE fee schedules (Table 7 MPE Square Foot Valuation) — see this dataset's electrical, plumbing, and mechanical permit entries.
  • Design to City of Elko Design Standards 2024: Seismic Design Category D0, Wind Exposure C with site-specific wind speed from ascehazardtool.org, 30 psf ground and roof snow loads, 30-inch frost depth.
  • Once plans are approved and fees paid, Municipal Code Section 2-1-5(J)(4) requires the building official to issue the permit within ten (10) days — and the applicant must first deliver two physical hard copies of the stamped, approved submittal documents (Section 2-1-5(J)(3)).

No. Commercial projects use the same universal City of Elko Building Permit Application and the same Table 1 valuation-based fee schedule as all other building permits. The commercial-specific parts are the Multi-Family, Commercial and Industrial Submittal Requirement Checklist, the requirement that a Nevada State Registered Architect or Engineer draw and stamp the plans, civil drawings, and approvals from six City departments plus any applicable outside agencies (Health Department, FEMA, EPA).

No. The commercial checklist states that only a licensed contractor of the State of Nevada can be issued a permit for construction, and the FAQ's owner-builder exemption is limited to owners who are full-time residents of a single-family dwelling. A Nevada licensed contractor may draw plans only for work the contractor itself is performing.

Per the fee schedule adopted by Resolution 18-25, valuation is determined from the current ICC Building Valuation Data, with the Building Department assembling updated valuation data every February and August; the permit fee is then read from Table 1 and the plan review fee is 65% of that permit fee.
