Commercial Building Permit (New Construction & Tenant Improvement) in Fallon, Nevada
Required for construction, alteration, enlargement, or remodeling of commercial buildings within Fallon city limits. The City of Fallon does NOT operate a separate commercial permit track: commercial and residential work run through the same Chapter 17.08 construction-permit process, the same City Engineer/Building Department review, and the same single Permit Application form — the form's Job Information section simply has 'Residential' and 'Commercial' checkboxes next to the Valuation field, and opens with a 'Tenant Name' field for tenant-occupied commercial jobs. Commercial plans are reviewed against the 2024 IBC (Appendices C, E, H, I), 2024 IEBC (for work in existing buildings/tenant improvements), 2024 IECC, 2023 NEC, 2024 UPC/UMC/IMC/IFGC, and the 2024 Northern Nevada Amendments, all as adopted by Ordinance No. 788 (December 2, 2025). When you need this permit
- It is unlawful to construct or commence construction of any building or structure without first applying to and receiving a permit from the city engineer; 'construction' expressly includes erection of a building, sign, plumbing, mechanical, electrical, excavation, and other work covered in the adopted codes (City Code § 17.08.010, re-verified live 2026-08-01)
- Application on forms furnished by the city clerk, accompanied by a detailed written statement or a full set of plans plus a plat or other showing of the owner's name and residence (City Code §§ 17.08.020, 17.08.030)
- Two (2) sets of plans including one (1) wet-stamped are required; minimum plan sheet size 11" x 17", maximum 24" x 36"; only complete applications are accepted and processed (City of Fallon Permit Application form)
- Check 'Commercial' in the Job Information section and complete the Tenant Name field (if tenant-occupied), Valuation, Zoning, Setbacks (front/side/side/rear), and FEMA Flood Zone fields (City of Fallon Permit Application form)
- Pre-acceptance approvals must be initiated by the applicant BEFORE the application will be accepted, each marked Approved or N/A: City of Fallon Variance; State Health Department (if the building involves food & drink handling); State and Local Fire Marshal; NDOT (if highway access to the lot is required); and a Geotechnical/Engineering Report (City of Fallon Permit Application form, page 2)
- Architect & Engineer information section (including the contact person responsible for plan revisions) must be completed where applicable (City of Fallon Permit Application form)

- Every business building must properly connect to the city's lighting, water, and sewer systems and have a toilet; structures suitable or intended for human occupancy require at least 500 sq ft of floor space, exclusive of porches, lean-to additions, and attached garage (City Code § 17.08.040)
- All work must be performed per the filed plans and not below the minimum requirements of the adopted building codes; altering approved plans requires notice to, and a new permit from, the city engineer (City Code §§ 17.08.050, 17.08.060)
- Occupying or using any portion of a public street for building erection/repair requires separate permission from the City Council, revocable at any time (City Code § 17.08.100)
- Commercial zoning standards (verified live 2026-08-01): C-1 and C-2 districts require one off-street parking space per 250 sq ft of gross floor area plus one space per service/delivery vehicle; rear yard of at least 10 ft where the lot is not bounded by an alley; a 5-ft side yard wherever a nonresidence district is contiguous to a residence district; open storage must be enclosed by a 6-ft structure or planting strip; marijuana establishments are prohibited in both C-1 and C-2 (City Code §§ 21.44.020, 21.44.030, 21.48.030-21.48.050, 21.52.020-21.52.040)

- Tenant improvement is NOT a separate permit type in Fallon — there is no TI-specific application, fee schedule, or timeline. TI work runs through the same unified Permit Application (which opens with a 'Tenant Name' field and a 'Commercial' checkbox) and is reviewed under the 2024 IEBC/IBC as adopted. This was confirmed from the City's own application form and a full review of Code Chapters 17.04/17.08 (re-fetched live 2026-08-01), not assumed.
- Initiate the page-2 pre-acceptance approvals EARLY: the application is not accepted until the City of Fallon Variance (if any), State Health Department (food & drink businesses), State and Local Fire Marshal, NDOT (highway access), and Geotechnical/Engineering Report lines are each resolved as Approved or N/A. For restaurants and food service, the State Health Department line is the long pole.
- No commercial building permit fee schedule or plan-review fee is published anywhere (City website, Municode ordinance text codified through Ord. No. 790, or reviewed council packets) — fees are set by City Council resolution under § 17.08.080 and the department fills in 'Permit Cost' on the form. Call (775) 423-5107 before budgeting. This is a disclosed gap, not an oversight.
- NAS Fallon / AICUZ: the City of Fallon's zoning code (Title 21, all 25 chapters enumerated live 2026-08-01) contains NO military-compatibility or AICUZ overlay chapter — the 'NAS Fallon Overlay' with AICUZ-based protection standards is Churchill County Code § 16.08.240 and applies in the unincorporated county, not inside city limits. If your project site is actually on unincorporated county land near the base (the city is an enclave within the county), the county's overlay and its Navy-consultation provisions apply instead — verify which jurisdiction your parcel is in first.
- The permit becomes void if not acted on within 60 days of issuance, or if construction is suspended/abandoned for 180 days after work commences (application form, page 2).
- The contractor line on the application requires BOTH a Nevada State Contractors License number and a City of Fallon Business License number — out-of-area commercial GCs should obtain the Fallon business license (gross-receipts-based, $50-$300+ per year) before submitting. Contractor
