Codes adopted
Colorado has no statewide-mandated building code edition. Under the Colorado Constitution's home-rule provisions (art. XX, home rule for municipalities since 1902; home rule for counties since 1970), building codes and zoning are an enumerated home-rule charter power, so cities and counties adopt and amend their own construction codes independently — predominantly the I-Codes, with editions and local amendments varying by jurisdiction. The one statewide floor is for energy: HB22-1362 (2022) created the Energy Code Board (jointly appointed by the Colorado Energy Office and the Department of Local Affairs) and requires that, on or after July 1, 2023 and before July 1, 2026, any municipality or county that adopts or updates a building code must adopt and enforce an energy code achieving performance equivalent to or better than the 2021 IECC together with the board's Model Electric Ready and Solar Ready Code (which includes electric-ready, EV-ready, and solar-ready provisions); from July 1, 2026 onward the floor shifts to the board's Model Low Energy and Carbon Code or an equivalent. Electrical and plumbing permitting defaults to the Colorado State Electrical Board and State Plumbing Board (within DORA's Division of Professions and Occupations) — the state issues permits and inspects statewide except in counties/jurisdictions that operate their own certified Electrical or Plumbing Inspection Program, in which case the local program has authority instead. Always confirm the currently adopted code edition, local amendments, and inspection authority (state board vs. local program) with the specific jurisdiction before submitting plans.
- 2024 ICC family of codes (IBC, IRC, IFC, IPC, IMC, IFGC, IECC, etc.) — per the Town of Nederland Building, Planning & Zoning Department's live 'Building Guides and Permits' webpage: 'The Town of Nederland is governed under the 2024 ICC codes, with 2026 National Electrical Code (NEC) in effect.' This is the department's actively maintained, currently published code-adoption statement and is treated as the governing current code cycle for this file.
- Prior/superseded code-cycle documentation still in circulation on the Town's own site: the 'Nederland Design Criteria' PDF (Other Helpful Information page) lists 'ICC IBC/IRC (Bldg. codes) 2018' and 'Nat'l Electrical (NEC) 2020 or most current'; the Town's Residential Solar Photovoltaic (PV) System Permitting Checklist (dated 'effective 1/1/2022') lists a full adopted-code table of 2018 IBC/IRC/IMC/IPC/IFGC/IECC/IPMC/IEBC editions, 2020 NEC, ICC/ANSI 117.1 (2009), 2018 IFC, and 2018 International Swimming Pool and Spa Code; and the Residential Application Checklist (SAFEbuilt Colorado submittal list) references '2018 International Code Council IBC or IRC compliance' and '2018 IECC Energy Code Compliance.' These are static PDFs that have not yet been updated to match the live department webpage's current 2024 ICC / 2026 NEC statement — the same stale-PDF-vs-live-webpage pattern documented elsewhere in this corpus (e.g. Vail). The live webpage is treated as authoritative for the currently adopted cycle; the older documents are retained here for transparency since they remain published and may still describe design/plan-review expectations SAFEbuilt applies in practice.
- HB22-1362 (Colorado statewide energy code floor / electrification-readiness requirements for municipalities adopting or updating a building code) was NOT found referenced anywhere on the Town of Nederland's Building, Planning & Zoning Department pages, adopted-codes statement, fee schedule, or permit-application PDFs during this review — checked directly. Nederland's own site states only that 2024 ICC codes (which as of the 2024 IECC cycle already carry more stringent efficiency provisions than 2018 IECC) are in effect, with no separate local ordinance citation for HB22-1362 compliance found. Not asserted as applying via a specific mechanism beyond the general 2024 IECC adoption; flagged as an area to verify further with the Building Department directly (303-258-3266) rather than invented.
Permit types & fees
Residential Building Permit (New Construction)
Required for new single-family and duplex residential construction in the Town of Nederland. Plan review and inspections are performed by the Town's contracted third-party firm, SAFEbuilt Colorado, applying the Town's currently adopted 2024 ICC code family and 2026 NEC, plus the Town's own Climatic and Geographic Design Criteria (55 psf ground snow load, 130 mph wind speed, 48-inch frost depth, required ice shield underlayment). A mandatory Concept Review/Site Plan Review with Town staff is required before permit submittal.
Residential Addition / Remodel Permit
Required for additions and interior remodels to existing residential structures in Nederland. Renovations/alterations of 20% or more trigger the same mandatory Concept Review/Site Plan Review as new construction. Plan review and inspection performed by SAFEbuilt Colorado under the Town's currently adopted code cycle.
Electrical Permit
Required for electrical installation, alteration, or repair work in Nederland. Nederland does NOT run its own local electrical contractor licensing program; electrical contractors are governed by the Colorado State Electrical Board (DORA) under CRS Title 12, and Town/SAFEbuilt inspectors perform contemporaneous field verification of State electrical licenses at inspection, per HB19-1086/SB19-156-derived guidance.
Plumbing Permit
Required for plumbing installation, alteration, or repair work in Nederland. As with electrical, Nederland does not run its own local plumbing contractor licensing program; plumbers are governed by the Colorado State Plumbing Board (DORA) under CRS Title 12, with contemporaneous field license verification by Town/SAFEbuilt inspectors.
Mechanical / HVAC Permit
Required for heating, cooling, and ventilation equipment installation or replacement in Nederland, including furnace and air conditioner installation/replacement, under the Town's currently adopted IMC/IFGC cycle.
Re-Roof Permit
Required for roof replacement/re-roofing in Nederland, processed via the One-Stop Building Permit track. Residential re-roofs follow the Town's Residential Roofing Requirements (2018 IRC-referenced document, Chapters 8-9); commercial flat roofs require a plan review against the jurisdiction's currently adopted IBC.
Rooftop Solar Photovoltaic (PV) Permit
Required for residential and commercial rooftop or ground-mounted solar photovoltaic system installation in Nederland. Requires a full Building Permit and plan review (not a One-Stop scope); solar thermal systems follow a related but distinct checklist referencing the 2006 IRC.
Accessory Dwelling Unit (ADU) Permit
Required for construction or conversion of an Accessory Dwelling Unit in Nederland. The Town publishes a dedicated ADU Application, Policies, & Procedures document; ADUs are otherwise processed through the standard residential building permit application and requirements applicable to their construction type (new build, addition, or conversion).
Electric Vehicle (EV) Charger Permit
Nederland publishes no distinct EV-charger permit type or fee line. A new circuit, outlet, or panel/service upgrade to serve an EV charger falls under the Town's standard 'Electrical Service Change' scope, processed via the One-Stop Building Permit Application, with electrical contractors verified against their Colorado State Electrical Board (DORA) license at inspection. The Town's population (approximately 1,500) is well below the 10,000-resident threshold that triggers Colorado HB24-1173's EV-charging-permit mandate, so Nederland is not confirmed to be legally required to have adopted EV-specific permitting standards.
Demolition Permit
Required for full or partial demolition of structures in Nederland, processed via the One-Stop Building Permit Application. Requires asbestos testing/abatement documentation and is subject to the Town's Construction & Demolition Debris Recycling Deposit Program.
Commercial Tenant Improvement Permit
Required for tenant finish, remodel, or addition work in existing commercial buildings in Nederland. Requires the full Commercial and Multi-Family Plans Submittal Checklist, plan review by SAFEbuilt Colorado, and (for restaurant/food-service tenants) grease trap/interceptor compliance.
Deck / Covered Patio / Carport Permit
Required for construction of decks, covered patios, pergolas, and carports in Nederland. The Town/SAFEbuilt publish dedicated homeowner guides for uncovered decks and for patio covers/carports, covering site plan, house/post attachment, footings, and cross-section requirements.
New residential construction activity
New privately-owned residential construction onlyHousing units authorized by building permits for new privately-owned residential construction — this is not total permit volume (no commercial permits or remodels).

Tips & gotchas
- Nederland contracts ALL plan review and inspection services to SAFEbuilt Colorado — the Town's own staff (Community Planner/Deputy Zoning Administrator) handle intake, zoning compliance, and fee/escrow administration, but code plan review and field inspections are performed by SAFEbuilt. Schedule inspections through SAFEbuilt's dedicated line (303-450-8745), not the Town's general Building Department number (303-258-3266). The Chief Building Official is Alejandro Pantoja.
- The Town's live Building Department webpage states the currently adopted code cycle is '2024 ICC codes, with 2026 National Electrical Code (NEC) in effect' — but several of the Town's own published PDFs (Nederland Design Criteria, Solar PV Permitting Checklist, Residential Application Checklist) still reference the OLDER 2018 IBC/IRC/IECC family and 2020 NEC. Confirm the current governing code edition directly with the Building Department (303-258-3266 / planner@nederlandco.org) before finalizing any code analysis, since several submittal-requirement PDFs have not yet been updated to match the live webpage.
- A mandatory Concept Review/Site Plan Review meeting with Town staff is required BEFORE permit submittal for all new construction, projects on sensitive land, or any 20%+ alteration/renovation — this carries its own $250 non-refundable fee plus an escrow deposit ($1,000 residential; $1,500-$2,000 commercial depending on parcel size), separate from the building permit fee itself. Budget calendar time for this meeting ahead of your permit application.
- Building permits will NOT be issued without an active Town of Nederland Contractor License ($125/year) — this is separate from and in addition to any Colorado state trade license (electrical, plumbing). Property owners are responsible for ensuring hired contractors pull appropriate permits; permit fees can be doubled if work proceeds without one.
- Nederland does not run its own local electrical or plumbing contractor licensing program — both trades are governed by the Colorado State Electrical Board and State Plumbing Board (DORA) under CRS Title 12, with Town/SAFEbuilt inspectors performing contemporaneous field license verification at inspection time, per Colorado HB19-1086/SB19-156-derived guidance.
- A Construction & Demolition (C&D) Debris Recycling Deposit Program applies to most building-permit-triggering projects (new construction, demolition, 20%+ remodels): $0.25/sq ft collected at issuance, 30% non-refundable, with the remaining 70% refunded based on documented waste-diversion percentage submitted within 60 days of Certificate of Occupancy. Projects requiring ONLY a mechanical/electrical/plumbing/HVAC permit (no separate building-permit scope) are exempt.
- One-Stop Building Permits (electrical service changes, siding, furnace/water heater replacement, re-roofs, replacement doors/windows, demolitions, and accompanied temporary/accessory structures) can often be processed same-day, with the Town's own Permit Turnaround Times table listing 3 business days generally — but commercial flat roofs and any One-Stop scope requiring accompanying documentation (e.g., asbestos results for demolition) explicitly will NOT be issued same-day and instead require a plan review.
- New residential construction plan review through SAFEbuilt is estimated by the Town's own Applicant Guide at 3-4 weeks, 'or longer for commercial' — this is the only jurisdiction-published plan-review timeframe found, treated as a verified estimate rather than a binding statutory SLA (Colorado is home-rule with no statewide review-time mandate).
- A Wildfire Mitigation Plan (defensible space) form is required for ALL new or remodeled residential and commercial buildings, reflecting Nederland's mountain wildland-urban-interface setting — this is reviewed and approved separately by the Nederland Fire Protection District (inspections@nfpd.org), not the Building Department itself.
- New construction requires a property survey no older than 5 years; an Improvement Location Certificate (ILC) is explicitly NOT acceptable for new construction (only for minimal-scope renovation with no footprint change) — budget time and cost for a current survey early in project planning.
- Permits become void if construction has not commenced within 180 days of issuance, or if work ceases for 180 continuous days; permits are not transferable to a new owner or contractor.
- The Town's Building Permit and Building Department Services Fee Schedule (Exhibit A) publishes only Table A (valuation-based Building Permit Fees) in its currently available single-page PDF; Table B (square-foot construction-cost data referenced in the schedule's own text) was not found published in that document — valuation is otherwise determined by the Building Official from the stated application value or ICC/Building Safety Journal data, whichever is greater. Electrical, mechanical, plumbing, plan-review, use-tax, county-tax, and utility-tap fee amounts are determined per-project by Town/SAFEbuilt staff at intake rather than published as flat rates or percentages — not invented here.
