Change of Use / Change of Occupancy in Nephi, Utah
Nephi does not publish a distinct Change of Use or Change of Occupancy application, checklist, or fee separate from its standard Building Permit process. The official Nephi City Building Permit Application (Rev. 12-6-23) itself captures a change of use directly on Page 1, with side-by-side 'Existing Use of Parcel' and 'Intended Use of Parcel' checkbox columns (Vacant, Commercial, Agriculture, Industrial, Single Family, Duplex, Multiple Units, Other/Specify) -- the same form used for new construction and remodels. Page 2 of the same application states directly: 'OCCUPANCY OF STRUCTURE IS PROHIBITED UNTIL AFTER FINAL INSPECTIONS AND CERTIFICATE OF OCCUPANCY IS ISSUED,' which functions as Nephi's change-of-occupancy control point. Nephi's 26-page Fee Schedule Report (effective 6/16/2026) contains no separate change-of-use or change-of-occupancy fee line item; a use change is fee-assessed under the same valuation-based Building Permit Fee (and Commercial Permit Plan Check Fee, where the change involves commercial space) documented on the other Building Permit entries.

When you need this permit
- A change in the use or occupancy classification of an existing parcel or structure within Nephi
- Completed Nephi City Building Permit Application (Rev. 12-6-23), with the 'Existing Use of Parcel' and 'Intended Use of Parcel' columns on Page 1 both completed to reflect the change
- Compliance with Nephi's underlying zoning for the intended use, verified through the Planning and Zoning function (contracted to Juab County) before the Building Department issues the permit
- Any construction needed to accommodate the new use or occupancy classification permitted and inspected the same as new construction or tenant improvement work
- Occupancy of the structure under the new use is prohibited until final inspections are complete and a Certificate of Occupancy is issued

Nephi City Fee Schedule Report (effective 6/16/2026): no separate change-of-use or change-of-occupancy fee line item exists anywhere in the 26-page document. A use change is assessed under the same valuation-based Building Permit Fee methodology documented on the Residential and Commercial Building Permit entries -- this is the genuinely governing fee for a change of use, not an omission.Review timeline

Final Inspection / Certificate of Occupancy
Occupancy under the new use is prohibited until after final inspections and Certificate of Occupancy issuance, per the official Building Permit Application (Page 2 conditions) -- the same final-inspection gate documented on the Residential Building Permit entry.

Tips
- Nephi has no separate, distinctly-named Change of Use or Change of Occupancy permit -- a use change is documented on the same Building Permit Application used for new construction, via the 'Existing Use of Parcel' / 'Intended Use of Parcel' checkbox columns on Page 1.
- Occupancy of the structure under the new use is legally prohibited until Nephi issues a Certificate of Occupancy, per the express warning printed on Page 2 of the official Building Permit Application.
- If the change of use requires construction work (remodel, tenant improvement, MEP changes), that work is permitted and fee-assessed under the Commercial Building Permit or Commercial Tenant Improvement Permit entries -- there is no separate, lower-cost change-of-use-only fee track.
- Planning and Zoning compliance review (the function Nephi contracts to Juab County) confirms the intended use is allowed in the applicable zone before the Building Department will issue the permit.

This page covers what the permit requires. What we don't have for Nephi yet is the record of permits actually issued — the history you'd search by street address. That is a gap in our coverage, not a statement about any particular property.
