Change of Use / Certificate of Occupancy Compliance in Bountiful, Utah
Bountiful City has no separately named or separately priced 'Change of Use Permit' product. Instead, Bountiful City Land Use Code § 14-1-106 ('Certificate of Occupancy and Use Compliance') makes it unlawful to occupy any building with a greater intensity of use or different occupancy than specifically provided for in its Certificate of Occupancy, and requires a new Certificate any time occupancy changes to a more intensive use. Separately, § 14-1-106.F ('Illegal Change of Use') makes it a class C misdemeanor to change the use of a structure or property to a use not permitted by current City ordinances without first obtaining required re-zoning, variance, or other use approvals. Where a use change does require such approval, it is priced through Bountiful's existing Planning Fees (Conditional Use Permit, Variance, Zoning Map Amendment, or Determination of Non-Compliance/Non-Conformance) rather than a distinct change-of-use fee.

When you need this permit
- It is unlawful to use or occupy, or to permit the use or occupancy of, any building or premises prior to issuance of a Certificate of Occupancy by the City (§ 14-1-106.A)
- It is unlawful to occupy, or allow to be occupied, any building with a greater intensity of use or different occupancy than specifically provided for in the Certificate of Occupancy (§ 14-1-106.A)
- A new Certificate of Occupancy is required any time the occupancy of a building changes to a more intensive use (§ 14-1-106.B)
- No building permit shall be granted for a change of use in any land, building, or structure if such change would violate any provision of the Land Use Code (§ 14-1-105.B)
- Any person who changes the use of a structure or property to a use not permitted by current City ordinances, without first obtaining required re-zoning, variance, or other use approvals, is guilty of a class C misdemeanor ('Illegal Change of Use,' § 14-1-106.F)
- Where the new use requires a Conditional Use Permit, Variance, or Zoning Map Amendment, that Planning Department approval process (and its fee) applies before the Certificate of Occupancy can be reissued
