Codes adopted

Idaho adopts a statewide baseline building code set under the Idaho Building Code Act (Idaho Code Title 39, Chapter 41) and IDAPA rules administered by the Idaho Division of Occupational and Professional Licenses (DOPL). Effective January 1, 2021, the statewide baseline includes the 2018 International Building Code (IBC), 2020 Idaho Residential Code (based on the 2018 IRC Parts I–III and IX with Idaho amendments), 2020 Idaho Energy Conservation Code (based on the 2018 IECC with Idaho amendments), 2018 International Existing Building Code (IEBC), 2018 International Mechanical Code (IMC), 2018 International Fuel Gas Code (IFGC), and 2018 International Fire Code (IFC). The National Electrical Code is adopted separately by the Idaho Electrical Board (IDAPA 24.39.10), not bundled with the building code: Idaho enforces the 2023 NEC, effective July 1, 2024 (the state used the 2017 NEC with amendments before that and skipped the 2020 edition). Local jurisdictions must enforce the state baseline and may adopt amendments only where those amendments are at least as stringent as the state-adopted editions; local amendments may not be less restrictive. Enforcement is local — each city or county issues permits and performs inspections. Always confirm the current adopted edition and any local amendments with your specific jurisdiction before submitting plans.

Tips & gotchas

  • Kimberly's Building - Planning and Zoning Department uses ONE general Residential-Commercial Building Permit Application for new construction, additions, remodels, repairs, demolition, re-roofing, signs, fences, and tenant improvements — the applicant checks the applicable 'Class of Work' box rather than filing separate permit-type applications for most of these categories. A separate application exists only for Manufactured Home placements.
  • Effective 02-09-2026 (Ordinance No. 689), applicants must e-mail a digital copy of the full building permit plan set to BOTH the Planning & Zoning Administrator (ceckles@cityofkimberly.org) and the Planner I (jtaylor@cityofkimberly.org), in addition to delivering two hard copy sets to City Hall — incomplete submittals will not be processed.
  • The City of Kimberly does NOT perform electrical, plumbing, or HVAC/mechanical trade inspections — those are handled directly by the State of Idaho. The City's own final building inspection cannot be scheduled until the State inspectors have signed off.
  • All inspection requests require 24-hour advance notice, Monday through Thursday; inspections requested on Friday are normally performed the following Monday.
  • Non-refundable building permit deposits are $150.00 (single- and two-family dwellings / manufactured homes on permanent foundation) or $100.00 (additions, alterations, repairs, accessory structures) / $50.00 (additions to manufactured homes) — these are applied toward the total permit fee, which is separately calculated using a per-square-foot valuation table: R-3 (residential) $45.75/sf, U-1 (utility/accessory) $36.00/sf, and covered porch/carport $31.00/sf.
  • Development Impact Fees (Police, Police Vehicles, Admin, Parks, Street, Library) apply per dwelling unit or square foot to new development under Kimberly City Code Title 17, Chapter 17.18 (Ordinance No. 671, effective March 28, 2022), and automatically escalate each January 1 for inflation using a municipal cost index unless the City Council elects to waive the adjustment. The Street impact fee for the Hwy 30-3400 Intersection service area was raised to $3,689.00 per dwelling unit effective 02-09-2026 (Ordinance No. 689).
  • Sewer Connection Fee is $2,000.00 and 1-inch Water Connection Fee is $2,800.00 — separate from the Development Impact Fees and from the base building permit fee.
  • A $238.80 Construction Water Deposit is required for construction water service and is refunded after the final Certificate of Occupancy inspection; only the City may turn water service on or off — unauthorized connection by a contractor/plumber/builder can trigger a $300.00 fine.
  • Idaho Code 39-4117 (effective 2025, statewide) requires the City to determine whether a submitted building permit application is complete within 10 business days (residential) or 20 business days (commercial) of receipt — this is a completeness-review clock, not a guarantee of full plan approval within that window. Kimberly has not published a separate full review-to-issuance turnaround time of its own.
  • Some subdivisions in Kimberly require compliance with CC&Rs and Homeowners' Association architectural design review — check with the HOA before submitting to avoid permit-issuance delays.
  • Land use information requests submitted to the Planning and Zoning Department may take up to 10 working days depending on the research required; requests must be submitted by e-mail to ceckles@cityofkimberly.org to create a trackable record.
