Change of Use / Certificate of Occupancy Permit in Peoria, Arizona
Required in Peoria whenever the existing use or occupancy classification of a building or portion of a building changes. Peoria's adopted 2018 International Building Code (Amended), Section 111.1, provides that a building or structure shall not be used or occupied, and a change in the existing use or occupancy classification of a building or structure or portion thereof shall not be made, until the building official has issued a certificate of occupancy. Peoria's simple 'C of O Only' building permit (application 400CofO) may be used ONLY where the proposed occupancy type is the same as the previous tenant's — a genuine change of occupancy type must go through a Tenant Improvement permit (application 400TI) instead.

When you need this permit
- 2018 International Building Code (Amended), Section 111.1 Use and occupancy, as adopted by City of Peoria Ordinance 2019-12: 'A building or structure shall not be used or occupied, and a change in the existing use or occupancy classification of a building or structure or portion thereof shall not be made, until the building official has issued a certificate of occupancy therefore as provided herein.'
- Peoria's amended Section 111.1 carries two exceptions: certificates of occupancy are not required for work exempt from permits under Section 105.2, and are not required for one- and two-family residences (only final inspection approval and a utility clearance are required prior to occupancy)
- The 'C of O Only' process (application 400CofO) may only be used if the proposed occupancy type is the same as the previous tenant's, and the tenant will occupy the suite 'as is' with no work — a change of occupancy type requires a Tenant Improvement permit (400TI) instead
- C of O Only plan submittal must be made online at devservices.peoriaaz.gov and must include one copy of the existing floor plan showing: the spec suite or existing built-out floor plan with all rooms labeled; the occupancy type/use, occupant load, and square footage of the tenant space; the location of an existing high/low drinking fountain or bottled water cooler if the occupant load is 15 or fewer; the location of an existing service sink inside the suite or a community service sink provided by the landlord (for all occupancies except B and M with an occupant load of 15 or fewer); the location of existing ADA-compliant restroom(s); the location of fire extinguisher(s); and the location of existing exit sign(s) and exit door(s)
- A separate letter signed by the tenant, stating what activities and uses will occur in the tenant space, must be included with the C of O submittal
- If the suite has never been occupied with the same use, mechanical outside-air calculations from an architect or mechanical engineer in compliance with IMC Table 403.3 must be submitted for approval
- Tenant suites with warehouse space must comply with the Peoria Fire-Medical Department Guideline and provide the information that guideline requests
- Tenant Improvement submittals must include a project information block with the address, legal description or assessor's parcel number, and the EXISTING use, occupancy classification, type of construction, and building area; plus a description of the tenant's use with a parking analysis/statement verifying sufficient parking for the use on the property or within the center (City of Peoria Handout 509, Tenant Improvement Standards)
- Because a change of occupancy classification can pull in fire protection requirements, note that a separate Fire Protection Permit is required for any modification to an existing fire protection system unless a Fire Department waiver has been provided

The building official issues the certificate of occupancy after inspection; Peoria's amended IBC Section 111.1 bars a change in the existing use or occupancy classification until that certificate is issued. Reinspections are $230 each (codified FEE TABLE 27-6).

Tips
- Peoria's cheap, fast 'C of O Only' permit is a trap if you assume it covers a change of use — the 400CofO application states in its own header that the process 'may only be used if proposed occupancy type is the same as the previous tenant.' An actual change of occupancy type is a Tenant Improvement (400TI) permit.
- That distinction is also the difference between a 2-business-day review (C of O Only) and a 12-business-day review (Commercial Tenant Improvement) on first submittal.
- Peoria works a 4-day week — Monday through Thursday, 7am to 6pm, closed Fridays. Every published review timeline is in business days on that schedule, so 12 'days' is three calendar weeks.
- A tenant use letter signed by the tenant, describing what activities and uses will occur in the space, is a required part of the submittal — not an optional narrative.
- If the suite has never been occupied with the same use, you must supply mechanical outside-air calculations from an architect or mechanical engineer per IMC Table 403.3.
