Change of Use / Certificate of Compliance in Show Low, Arizona

Covers a change in the use or occupancy of an existing building or space in the City of Show Low (for example converting a retail suite to a restaurant).   • Show Low Municipal Code § 18.20.020 (Certificate of compliance): 'The certificate of compliance is for existing structures. It may be associated with removing, relocating, renovation, use change, addition and existing structure or housing code. A letter of certification (duplicate certification) may be for other than the original issue.' This is the only place in the Show Low code that names a use change as its own certificate trigger.
  • Show Low Municipal Code § 18.20.010 (Certificate of occupancy): when final inspection indicates a building is in full compliance with applicable codes, a certificate of occupancy shall be issued; no building may be occupied for any reason or purpose until after a final inspection has been performed and the certificate of occupancy issued. A temporary certificate of occupancy may be issued for a specified period where uncompleted items are not a threat to occupant health and safety. Certificates of occupancy are not issued for accessory buildings.

Tips

  • There is no form called 'Change of Use Permit' in Show Low. The instrument the Code actually names for a use change in an existing structure is the Certificate of Compliance (§ 18.20.020) — ask Building Safety for it by that name.
  • A change of use does not automatically mean full development-impact fees: § 18.25.100(B)(2) limits the development fee on a change in use to the INCREMENTAL increase for the additional public facilities needed, and § 18.25.090(C)(3) exempts activity that does not increase demand for public facilities at all.
  • Check the zoning district use table before budgeting. If the new use is permitted by right, no Conditional Use Permit is needed and neither the $150 filing fee nor the public-hearing calendar applies; if it is a conditional use, the Planning and Zoning Commission — not staff — decides, and may attach conditions.
  • A pre-application meeting is mandatory for substantial commercial remodels under § 18.15.060 — call 928-532-4040 before assembling a submittal; commercial tenant improvements need four (4) plan sets and a $200 deposit at submittal.
