Change of Use / Certificate of Occupancy in Draper, Utah

Draper does not publish a standalone, separately-fee'd 'Change of Use Permit' product. Instead, City Code Title 10, Chapter 5 requires a Certificate of Occupancy before any building or structure is used or occupied, and expressly extends that requirement to 'a change in the existing occupancy classification of a building or structure or portion thereof' (Draper City Code § 10-5-010). The Certificate of Occupancy itself carries no distinct line item in the Consolidated Fee Schedule (Resolution 26-29) — the full fee schedule (items 1-540) was checked directly and contains no 'Certificate of Occupancy' or 'Change of Use' fee. Where the change of occupancy requires construction (e.g., converting retail space to a restaurant), that work is billed under this file's commercial-building-permit or commercial-tenant-improvement-permit entries, whose fees already appear there and are not duplicated here.

When you need this permit

  • No building or structure may be used or occupied, in whole or in part, nor may a change in existing occupancy classification be made, until the City has issued a Certificate of Occupancy (Draper City Code § 10-5-010)
  • No Certificate of Occupancy will be issued until all required public improvements (curbs, gutters, sidewalks, water meter boxes, street paving, sewage/storm/flood/fire control facilities, etc.) are completed and operable, or repaired if damaged (§ 10-5-020)
  • The Building Official, with approval from the Community Development Director, issues the Certificate of Occupancy only after inspection finds no violation of the construction codes or other applicable law (§ 10-5-030)
  • A Notice of Disapproval is issued if the building or structure does not comply (§ 10-5-040)
  • A Temporary Certificate of Occupancy may be issued for incomplete work only if it would not create a substantial hazard or violate code or state law (§ 10-5-050)

Fee schedule

Certificate of Occupancy / Change of Occupancy ClassificationChecked the full Draper Consolidated Fee Schedule (Resolution 26-29, July 2026, items 1-540) directly — no 'Certificate of Occupancy' or 'Change of Use' line item exists. Draper City Code §§ 10-5-010 through 10-5-050 impose the Certificate of Occupancy requirement (including for occupancy-classification changes) but specify no fee. Where construction accompanies the change of use, the standard valuation-based Building Permit fee (100% of the ICC Schedule, item 44) plus 65% plan review (item 45) applies instead — see the commercial-building-permit / commercial-tenant-improvement-permit entries in this file.

Tips

  • Draper has no separately named or fee'd 'Change of Use Permit' — the operative mechanism is the Certificate of Occupancy requirement in City Code § 10-5-010, which explicitly applies to a change in existing occupancy classification, not just first-time occupancy.
  • If the new use requires construction, apply for the underlying building/remodel/tenant-improvement permit — the Certificate of Occupancy is issued at the close of that process with no separate fee.
  • If no construction is needed but you want written confirmation of zoning/use compliance before a lease or sale, the $50.00 Zoning Verification Letter (Resolution 26-29, item 409) is the closest standalone product Draper publishes.
  • A Certificate of Occupancy will not be issued until required public improvements (curbs, gutters, sidewalks, utilities, etc.) are complete and operable (§ 10-5-020).

Not as a separately named, separately-fee'd product. Draper City Code § 10-5-010 requires a Certificate of Occupancy before any change in a building's existing occupancy classification, but the Consolidated Fee Schedule (Resolution 26-29) has no distinct fee line for it. If construction is needed to accommodate the new use, that work is billed under the standard Building Permit (or Tenant Improvement permit) fee, and the Certificate of Occupancy is issued at the close of that process at no extra charge.
